No Charges for Biker Who Fatally Shot Woman After She Hit Him With Car

Andrew Derr, a 40-year-old motorcyclist, was cleared of any wrongdoing in the fatal shooting of Sara Morales, a 35-year-old library assistant who allegedly intentionally hit him with her car.

In November, Morales hit Derr with her blue Kia and fled the scene, according to the Orange City, Florida, Police Department. After failing to get her to pull over, Derr and other motorists followed her home, where she allegedly obtained a gun and pointed it at Derr. The 40-year-old then took out his own firearm and fired multiple rounds, fatally wounding Morales.

On Tuesday, the Orange City Police Department confirmed to Newsweek that Derr would not face any charges in the shooting.

"While the facts in this case are truly heart-breaking, the law does not authorize the filing of any criminal charges. Our sincerest thoughts and prayers go out to the Morales family," the State Attorney's Office told WFTV in a statement.

Ahead of the shooting, Morales yelled at the people outside her home that "three men" followed her, according to a 911 call WESH published in November. Shortly after, shots were heard in the background and the caller told the operator that the "dude that got hit on the bike" shot the woman. The caller said the shooting occurred because "she pulled a gun out on him."

Derr remained at the woman's home until law enforcement arrived and Orange City Police Department Lieutenant Jason Sampsell told Newsweek in November that he didn't anticipate charges would be filed.

A police report obtained by Newsweek said Derr was worried that Morales was going to "shoot him and that he was going to die." Derr told WOFL at the time that he felt terrible about the shooting but felt he had "no other choice."

Better yet if someone is following you home. Don’t go home!  In her case I guess she wasn’t going to the police station but that still would have been safer. If the shooting didn’t happen the biker dude was surely going to call 911 anyway.

I don’t have any facts of the case, but my intuition tells me this lady had some mental issues to set all this off.

Absolutely.

Years ago, I had a completely psycho lady lose her mind at me when I wouldn't let her cut in to a longstanding (for years) line to make a right turn.  So she cut off the guy behind me and followed me back into my subdivision (horn honking, lights flashing, fist shaking) (really quite emotional).  

I just drove the normal 25, watching to make sure she didn't decide to ram me.  I did not go home, but just drove around the neighborhood.  When she realized I was just driving around in circles, she lost her mind even worse, so I slowed down to 15 (to enhance the insanity).

About the fifth time around, realizing she wasn't going to give up, I picked a good spot and slowed to a stop, put it in park, rolled down my window and looked at her over my shoulder.  Finally having a chance to give me a piece of her mindless mind, she jumped out of her car and marched up to my window.  I held up my index (not middle) finger and said..... have a nice day, and gunned it out of there, and once out of sight, turned the opposite way I had been going, ran home and up my drive into hidden landscape.

I never saw her again, but I think her head exploded.  Hopefully.  

If you are being followed, never go home.

The finest technique for being followed is to use the Bullet technique and get behind the follower and follow him.  




But watch out for the guy in the backseat with the shotgun.

Was wondering if anyone came forward, or would, that could shed some light on why she did what she did. Or, if she actually did it intentionally.

He should of just called the police and filed a report with the info he had. Confronting a person has such a potential for ending badly.

I cannot imagine what would be going through the woman's mind to get out a gun probably without calling police to go out and shoot someone.

 Years ago at thanksgiving we all got together at our house. My older brother drives up to the house with this jackaas right behind him yelling and screaming at him. I go out in the front yard as my brother passes me and goes into the house leaving to deal with this moron. Evidently my brother cut him off in traffic and he wanted to let us know it wasn't acceptable. Since my brother is no longer present he proceeds to go off on me on how he's in a hurry and my brother was an idiot for cutting him off. I said "well if you're in such a freaking hurry why in the hell are you arguing with me". He kept ranting and raving when my younger brother Chris comes out. He proceeds to call us a bunch of names including fatasses which my brother Chris laughs and says "I've been called worse by better" then Chris goes back inside and grabs the side by side 12 Guage my dad kept over the clock in the living room and comes out with it behind his back. I don't know if the jackass saw it but I told him it was time to leave or I will call the cops. He yelled out a few more insults and gets back in his car and leaves. Now the kicker. All the time he's doing this his young son is in the car watching dad being a absolute moron. Priceless. Later I thanked my brother for bringing that freakshow to the house....

me being a dummy on my 250cc scooter in big city going OVER the posted speed limit already was being tailgated VERY closely so I let go of the right hand throttle slowing down and turned my body around and flipped her my middle finger, then sped back up.  Luckily, she backed the F off and did not run me over as some would.

do not do that.  I thought afterwards on how easily a crazy person could've ran me over.     besides flipping the bird at her,  whatcha going to do?  speeding up would not have been good already speeding and slowing down not good either ticking her off even more.  NO where for her to pass me either in traffic coming at us.

The best solution to a chronic tailgater is to pull over (or off) and just let them pass. 

I stood on my brakes a few times in my youth, and once she hit me.  So I quit doing that.
