It allows family members or those who live in the same household to submit an application to state Superior Court showing why a judge should issue an “extreme risk protective order" to keep guns away from someone “who poses a danger of causing bodily injury” to themselves or others by purchasing or possessing a gun or ammunition.

It also allows law enforcement to petition the court.

People who are neither family or a law enforcement officer can ask a law enforcement agency to file a petition.

It seems a wise law to me, depending on the process.  That is, depending on the answers to the questions, does the gun owner have a right to testify in his/her defense and cross-examine the person(s) wanting his guns removed?  Are the guns held in trust for him/her?  Will there be compensation for the value of the guns/ammo if permanently taken?  Is there and expiration date on the order and/or a process for overturning it when the owner becomes stable and responsible?

These new "red flag" laws are rife for abuse, notwithstanding their already infringing on our consitutionally guaranteed rights.  eg, an angry ex can call one in and they will honor it sans vetting the situation.  Many more examples, google to find them.  Our wonderful new extreme left gay governor has signed the law which goes into effect in January.  There is a recall petition in the works.  No doubt it will fail with all our fabulous immigrant californicators.

                  What the heck happened to checks and balances? While I owned my projectile firing weapon(s) not one of them EVER jumped up and shot me or anyone else. I ride with folks that CCW and not a one of their weapons discharged accidently-NO NOT ONE. Seems like some folks goin hard after our 2A rights. Reminds of this-how duz ya eat an elephant? One bite at a time. 2A RIGHTS are the far lefts elephant. Think bout dat fer a spell. RIDE SAFE.
