and all over a shoplifter. and funny the supreme court ruled yrs ago police are not required to protect anyone.

The court acknowledged that this may seem “unfair,” but when police have to protect the public, they can’t be “burdened with the condition” that they compensate whomever is damaged by their actions along the way.

“It just goes to show that they can blow up your house, throw you out on the streets and say, ‘See you later. Deal with it,’ ” Leo Lech said in an interview with The Washington Post on Tuesday. “What happened to us should never happen in this country, ever.”

That's a hard case.

But the authorities offered $5K in rent, and to cover the deductible on the homeowners.

The article made it pretty clear they were well insured.  AND the deductible was offered, but not accepted.

Probably not accepted on civil counsel's advice.

So they were made whole financially, just not allowed to take a tort claim to a jury for megabucks.

I don't like they lost their house.  It also seems the barricade (by a shoplifter) went a bit extreme by the police.  I really wonder if the department fully supported these tactics.   But this is good law.  

On the other hand, if that was my house, I'd sneak around back and let myself in with a key, and shoot the perp before they blew my house up.

near the end of the article other cases are listed that went against the police. still a little overboard for a shoplifter. it seams the cops were in a hurry to arrest him.  a show of force as a lesson to others. it was done in my town to the house next to me. police report posted in the news and on their website was nothing like what happened.  arrest warrant court appearance failure for stealing at the store he was working. cops attacked the house 0200 swat team, vehicle crash through front door, etc. cops w/m16s position on my front lawn whereas they couldn't even see the kids house, I live on a curve. their report stated they called the house 1700 and knocked on door but no answer to either. none of that ever happened except them showing up at 0200.

Well I'm certainly aware of many wrongful PD actions, and property destruction on warrant execution, and making the paperwork look better than the facts.  And kicking in the door and abusing the occupants and their property, only to discover it's the wrong house.

I'm pro cop, but I don't hold with any of that.

yep many cases today esp swat teams going to wrong house and actually have killed innocents and family dogs. from what I have read nothing ever happened to those swat members that kill those people. cops need to be 200% correct when attacking a house, they need to tighten up their actions and policies.

OK, that sounds better / more fair . I'm all for the PD / government making the unintended victims whole, but not for said victim to make a megabucks tort claim for far more than they actually lost.
