As you know I represent small landlords in my Bronx practice
Back about six months ago, on a zoom call with hundreds of attorney and many jurists
I offered a plan to 100% safely get cases moving using zoom and an empty school
The response from judges was we do not want to do that  DiBlasio the same
Court closed March 13 locked up tight till recently but no trials, no appearances in person, no judgments and warrants may not issue even on drug dealers, violent people, squatters

Many of my clients are seniors, widows, people whose life depends on that rent or getting that unit back

A week ago I sent an email (I thought to a friend but it went to the list)

In the email I said that under the plan the judge and clerk could be safe in the part and
no worries about "chinese cooties"

You would think the world ended from the left and minority folks losing their minds

I was written up in the New York law journal  Lawyers Racist Slur

So it is ok to say German measles, Spanish pandemic/influenza but not ok to say chinese cooties

A chinese lawyer mentioned he had been spit on in the street, no further explanation given
Surely he was NOT spit on by me nor did my words cause the event
That a person is spit on is terrible and unexpected and I said so.   It is also terrible that mobs are rioting and killing black and white people in the name of black lives matter but that will get no
mention from any supposedly enlightened organization

So I apologized to the attorney who was spit on and explained further
Then was by phone interviewed by a reporter from the Daily news as well.

I said it will get worse before it will get better for those chinese people  WHY?  Because people will lash out when they think they cant do anything else thats why  To state what should be obvious is not to condone the obvious but the left does not wish to reason only lash out

The hate keeps coming from the left who do not want evictions, ever  My head is held high My clients love me

Court is effectively closed to landlords as they can not get evictions even on cases they won a year ago

Tomorrow again at noon I will be at 161 & Grand Concourse with my clients, mostly minorities. Holding signs to give justice to small landlords

If I dont make it back you know the true story now

Sheesh, with thousands fleeing NY, one of them could be you? Higher taxes and crime are driving people away, just like here in Ca.

Governor Cuomo defied the NYS and Federal Constitutions as well as the common law
MAGNA CARTA by his Executive Orders.  There have been many of them 1st to June then August now October

You are probably referencing POTUS decision to allow CDC certain authority but not to Holdover, drug dealers etc. until the end of the year

A NONPAYMENT case is one based on tenant owes rent under an existing lease.
The legal aid attorneys are good at getting $ from NYC and NYS for rent

A Holdover case is where no lease. Tenant is supposed to LEAVE when lease is up. Even after 90 day notice and court case dragging a year and another year for covid delays where was the justice for the small landlord?  No rent, No cares money,  What about the people who bought a home but can not get in because former owner wont move? or where there is a squatter or illegal apt?  All Landlords are
totally denied access to court   It is the biggest shame on our court system since before the civil war

I was not around then, but the Magna Carta in 1354 expressly stated, “No man of what state or condition he be, shall be put out of his lands or tenements … without he be brought to answer by due process of law.”  By refusing to hear any evictions actions, the New York Courts are keeping rightful owners from possessing their own land without any due process rights whatsoever.

 Sorry for your troubles Even.  That sucks. I'm just tired of everyone blaming Trump for everything that is wrong in this country. CA wildfire's, Corona virus,riots in Dem controlled cities,Dogs and cats living together all Trump's fault...

Hey Oss, I feel bad for all your troubles. As the saying goes “and the hits just keep on coming” certainly holds true in your case.

I can only mimic what a couple guys said about being proud of you, keeping your head up, working for the little guy and being a light and a voice in the darkness.

I wish I could fight the fight with you but I’m and so many are there with you in spirit. I know it’s not much when you’re dealing with all the crap but we got your back.

When you need to vent let it all out...no worries here.

I’m not sure if you’re a Springsteen fan or not but this has gotten me through some crappy times and it’s from before he got political.

Evan, it's probably more surprising THEY haven't gone after you for trying to enforce landlord (property) rights and evictions (at this time), than for calling this virus the Chinese Cooties.  And maybe/probably one is driving the other.

The Chinese Flu may have gone over better than the Chinese Cooties.  Cooties being mildly disparaging.

I've only ever called it the Kung Flu, which doesn't name China at all, just points a big (middle) finger at them.

And Serk, it's hard to believe I lived long enough to agree with Bill Maher about anything (or even watched one his diatribes again).   I hate it when he makes sense.  Grin

This is a slippery slope.

I understand the reasoning behind it on a moral ground to help those out of work and fearful of being put out to the street as well as the political/election side of it and I also undertake the the landlord side of it as loss of revenue, the inability to pay property taxes as well as their bank notes.

I hate to say it but the hopes of gaining votes from the tenant side outweighs the votes from the owner/landlord side.

As I said this is a slippery slope, one I’m not too fond of.

NYC tenants are extremely knowledgeable in the rental real estate laws and use those laws to their benefit.  Wherever there is a "system", someone is out there beating that system at someone else's misfortune.

Tenant has burden and it should not impact holdover cases
I made 6 motions to get permission to serve notice of evictions which will be heard...... sometime after Oct 5
We will see
Got a young man from the hood near court to stand with us today.
Believe it or not he is a Hispanic Bronx Republican and planning to go to law school
We had a good time for 90 minutes before I had to drive back to the office
He was effective today once I kept him on target and has potential to make a difference and I told him so.

The fight continues  A good day for our small landlords to be heard
More people honking support with thumbs up as Cuomo continues to show he is not to be trusted or believed

  It is easy , just tell the bank or mortgage loan company that the tenants do not want to pay rent and it will be OK. They will forgive you of the loan and not for close on you. 
  One of my tenants asked for a rent reduction.  I told them to call my bank and get me a loan reduction.
