Florida Gov. Ron DeSantis (R) is pushing "anti-mob" legislation that would reportedly allow citizens to confront looters with firepower.

The bill, which comes after months of civil unrest in the wake of George Floyd's death, would broaden Florida's Stand Your Ground law by expanding the "forcible felonies" list to justify the use of deadly force against individuals engaged in criminal activity resulting in "interruption or impairment" to a business, according to the Miami Herald.

That legislation would also justify deadly force used against individuals engaged in looting businesses within 500 feet of a "violent or disorderly assembly."

Also, the bill DeSantis is promoting would give immunity to motorists who "unintentionally killed or injured protesters who block traffic," the Herald reported.

Will be interested to see if this or a similar bill will become law.

I'm quite sure many small business owners would like to be able to protect their businesses, property and employees.

I’ve not seen riots or looting personally but watching it on the news I have thought if someone was on the hood of my truck bashing my windshield with me inside that threat would be eliminated with two or three rounds from my .357. Now it’s going to be completely legal in Florida. Gotta love our Governor

Texas is a property state. You have a legal right to protect yourself and your property using lethal force if necessary. Period.
Most other states like TN are life states, you can only use lethal force if a life is in intimate danger. you have to use your own discretion.
Personally I like the Texas laws and wish it were like that here.

Although I don't know all the ins and outs of the Texas law, I believe I could easily support it based on my limited knowledge.

A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41 ;  and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime;  or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property;  and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means;  or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Regardless of the particular state law, if you have to shoot someone (yes, some people need to be shot), you are wise to let the police know you were "in fear for your life."   Lips Sealed

That TX law covering deadly force for property is pretty particular, with a lot of ands or ors.

Before I ever relied on it (using deadly force), I'd know it like the back of my hand.

I was in reasonable fear of death or great bodily harm (or others were) is a lot easier to remember... and follow.

Of course, if in protecting your property, you walk right out there armed and ask them what the hell they are doing, and they then offer you a deadly threat, then you don't need a special property statute.

Walking right out there may or may not be such a good idea.

Modern technology being what it is, putting a green or red dot on them (from behind good cover) and asking what they are doing may be the better strategy.  And if they run like hell, I'd sure think twice before inflicting wounds from the backside.

But every man should do what he thinks is right.   But no man should happily volunteer to be the subject of a criminal/grand jury investigation (with associated expenses, risks and worry).

Now if there is a full blown riot with violence, burning and looting going on.... a relaxation of the rules on self defense seems completely reasonable.  For both good citizens and policemen too.

I'm glad you brought this up. Our Gov. DeSantis is a guy that understands the way to STOP or eliminate  the action of the lawless. He is doing a fine job.  coolsmiley
