I am not surprised at all they called the lawyers on the case of the election fraud and made all kinds of threats.
What is sad is those who voted for Biden condone this.
China under Biden has already opened its doors to the US with a stipulation that we be good and they will sell to us.

I guess we see assholes from different perspectives. It's a short video. We don't see the context. Perhaps one of our attorneys will help or correct me but doesn't one have to touch someone else to be charged with assault. I wouldn't go straight to the asshole accusation for the idiot lady but she is an idiot. If she's "approaching 70" she is not in the highest risk category. At her age even if she catches the disease she has a 97% chance of recovery. Two more risky categories up they still have an 86% chance of recovery. Does assault include aggravating someone's stupidity?

I don't think he can be charged if he didn't have it or didn't know he had it. The conversation immediately before the breathing: The woman: "You don't get up in somebody's face." Traditionally/historically:
A battery is an unlawful/unwanted touching.
An assault is an attempted battery, without touching, but putting a victim in reasonable fear of an immediate unlawful/unwanted touching. Though with various diseases like AIDS this would regularly now include spitting at or perhaps even sending diseased wind at someone) (spitting being a serious problem in prison populations).
However the devil is in the details as old (criminal) common law is everywhere codified by statute language that is certainly not identical in every state (though many would be close).
Some have assault and battery as a single crime (with several or alternative definitions), but it is often referred to only as assault, just in brevity. Even by the cops and certainly the media and movies/TV. So assault has a legal definition in each state, but also a generic lay definition everywhere.
And then there are usually levels of culpability, like simple misdemeanor up to (felonious) aggravated assaults with a weapon or other means likely to cause death or serious bodily injury (like using knives or clubs or... shooting at someone and missing, or hitting someone with your car, which could also be the greater offense of attempted murder, if that was the actual provable intent).
Knowingly, intentionally trying to give someone a deadly disease could rightfully be charged as an assault (not that deadly) or even an aggravated assault (very deadly). (but you would have to have the disease, and know it, for the wrongful intent element of the crime to be complete) (though if you don't know and don't care, that might be enough bad intent these days)
So then we would have to assess the actual deadliness of the RONA (which is far less deadly than regularly advertised, though it can have some very nasty residuals), and we would also have to assess the actual reasonableness of the woman's fear or belief that she was really in jeopardy of a simple battery (easier), or even her life or great bodily harm (harder).
And while breathing on someone (from 2 inches or 4 feet?) would not ordinarily be something to be reasonably afraid of, the fear created by media and politicians is certainly heightened at present (very much on purpose). Making fear more reasonable.
And charges like this are to be expected right now to set examples, even if the cases are later dismissed, or plead down to spitting on the street or whistling in public.
I cannot conceive of a trial where Kyle Rittenhouse can be proven beyond any reasonable doubt to have committed intentional murder. That didn't stop them from laying on those charges anyway (and a 2 million bond no one thought he could ever make).
Politics should not influence the ordinary administration of the criminal justice system. The lady statue holding the scales of justice is supposed to be blind or blindfolded. But that is not always the case, and it seems worse now than ever. Defenders go to jail, and rioters go scott free.
The people and population are to be controlled, cowed and trained. Individual freedom and liberty are to be curtailed. The individual is nothing. The state (and party) are everything. Where have I heard this before?
