Quite the contrary.  I'd observe that woman certainly doesn't know how to drink.  She was well beyond the level that is normally considered lethal and certainly had long since passed any benefit she could have derived from ingesting the drug.

So true. If she is a chronic drinker, which I'm betting she is, she has to 'maintain' a level normal to her in order her to function without going into withdraws or DT's. My guess is above .4 Some chronics can maintain a .3 and function as normal as someone who has had 2 drinks. We have alot here in town, and coincidently alot of mopeds.  Undecided

Mopeds dont even get by with it in KS. Riley county once gave a man in a motorized wheel chair a DUI and it stuck! He was in traffic throwing stuff and yelling. Even on private property,operating a motorized vehicle....Mowing the lawn while hammered could land you in jail! 

Thats why I'm training the horses to pull a cart !  uglystupid2

They got a guy here for driving a horse/cart UI. His lawyer (successfully) argued that the horses were actually doing the driving and it didn't apply.

We had a man here in MN. that had three DUI'S. He was washing his truck in his own driveway. Raido on detailing his truck and drinking a couple of adult drinks. The police gave him a DUI ticket hauled him off to jail. This also let them take his new truck. I think this is going too far.

Enforcement abuse or misapplication is no reason to be against good laws.

For every incident of someone being charged for operating a lawn mower (?) I'm sure you can find a dozen instances of someone operating a motor vehicle who took away the life of someone's daughter, mother, son, or brother.

I believe the DUI laws are much too lenient and not enforced stringently enough.

I strongly support the "Over the limit, Under arrest" campaign.

While I agree with Willow's post about the severity of DUI's and the need for punishment..............

This is an extreme example of Abuse of Police Power.  Most likely motivated more by the ability to conviscate his truck rather than preventing a DUI.

Hopefully he has a good lawyer that can get this tossed, not so much for his benefit, after all he did have previous DUI's, but this sets a serious precident for the guy with no Previous DUI's or intent to drive who wants to enjoy a few beers while he details his Car, Truck or VALK within the confines of his own driveway.

I agree with the laws to a extent. I totally agree 100% with being on the road and getting pulled over if your over the limit.  Its the other stuff I don't agree with.
The next city over, which is a large city, is one of the top DUI arrest cities in the country. So big infact that they recieve hundreds of thousands of dollars for enforcement from the Gov.
Last winter a guy rolled his snowmobile, on his own property. Booked with DUI. Now he lost his lisc for 3 months and he was not even in a 'vehicle'. If I want to have one at home then decide to go out in the field and dig up field tile to replace and something happens and I get booked for dui, thats bull. I'm not even on the road. Same if I want to have a Bartels & James on the mower. Oh boy open container! The judge here in town don't care. You get the 2 days in jail and no lisc for 3 months. The non 'vehicle' arrest do happen.
Dad told me the other day that a local cop was 'fishing' for DUI. The cop called a gas station at 2am and asked if anyone is there that appears to be under the influance. She said yes and a guy was booked. Dad told the cop he is a ass for having someone else do his job. The 'intoxicated' customer did not disturb anyone or anything in the store.
I don't agree with them sitting outside a bar at 3a waiting for you to leave. Which they do here. Nor do I believe in DUI 'check points.' Thats a whole nother legal issue!  uglystupid2 Like dad said, its not like it was when he was a kid. The cops would take you home instead.
I'm glad I always have other options to get back home. I was even the DD on New Years Eve!
As a side note, I lost a best friend in HS as he missed a curve after drinking. I can't tell you how many time we had to get the keys away from him.

My parents had a restaurant, every Friday and Saturday night we’d get the drunks at 2:00.  it amazes me that more people don’t get killed after 2am in Wisconsin on the weekends.  Sadly, the drunks live, the innocent die.

I have to agree with Fudgie here.  If you are driving drunk on public roads endangering others, then by all means, arrest the guy and take his license away.  But if you are off the road (like say on a farm) driving your ATV or lawnmower or even your pick-em-up truck, there is no reason to harrass someone...unless of course they are causing problems with neighbors or something.  But even then, it shouldn't be DUI.  It should be something like disorderly conduct.

I've seen where people have been arrested for DUI even when they weren't even driving.  They were drunk...knew they were drunk...and had the sense to not drive.  But the bar had closed, and out where I live, public transportation is not available.  So where could they go?  They went to their car and passed out for awhile to sleep it off.  Next thing they know, they are being arrested for DUI because a cop decided to check out the car in an otherwise empty lot of a closed establisment and they are the only one in the car and are therefore deemed "in control of the vehicle".  Instead of arresting them, they should be applauded for being responsible enough to not drive.  But then again, there's no revenue in that.
