Yes - the CDC DOES NOT have the authority to issue eviction moratorium orders, without specific authorization from Congress.

If you are going to to put a moratorium on evictions, you should similarly protect the landlords (especially the small ones, like OSS's clients).

What I find interesting is, this is the second time that SCOTUS has ruled on this.   SCOTUS said in their first finding that this was something CONGRESS has to address, not the CDC.   SCOTUS didn't say evictions could not be stalled, just that the CDC had exceeded it's authority and even gave hints on how it should be done.

Speaker Pelosi had lots of time to try and get some kind of legislation done to address evictions during this COVID time frame.   But, she did nothing.   Now, she saying how immoral SCOTUS is.   Roll Eyes

The definition of hypocrisy should have a picture of the Speaker as a visual aid.  coolsmiley

The new NY Governor is seeking to exceed what Cuomo has done to hurt small landlords

So far I have 5 clients who will pitch in so I can sue to open Housing Court by going to Supreme Court
Only those who are being hurt have standing

Not a lot but like the story of the emperors new clothes it only really takes one to point out
what should be obvious

I do not subscribe to the view that any administrative body can block any right under the Constitution without the express consent of the governed

They get away with it because like good sheep we let them

I wouldn't have been a landlord before this mess and certainly wouldn't now.
I can only imagine what a renter will do to find new housing.   
Seriously, if a renter didn't pay rent during this time frame, why would they think another landlord would rent to them............   uglystupid2

My personal experience view, I rented for much of my life.  My ex did until she killed herself by smoking - even after lung cancer she kept on puffing.  So glad we bought into the American Dream in '96 and stopped throwing away money on rent.  And since paying off the mortgage have only taxes & utilities (and maintenance) for domecile expenses.  WOW how rent cost has excalated, like a house payment, w/o building any equity.  I feel so bad for folks like Oss's clients.  And all the rest of us, especially for those working hard, paying to fill the gov't teat for deadbeats to suck on.  What a CROCK, how the libs are screwing landlords/us.  And it appears the general public is OK with that.  We are well on the way to ruin.  God help our kids when they have to pay the piper.  Many of us - and the libs causing this - won't be here.

I owned rental property when living in the sunshine state. Like a boat (that sank with all my firearms aboard), the happiest day of my life was when someone else owned it. No more dealing with HUD and the possibility that I might discriminate against people that have no intention of ever paying rent, regardless of color or religion.

The bride occasionally mentions that we should buy a few rental properties in the area and all I have to do is remind her of the evection process before she agrees that it isn't such a good investment. Check your local evection laws' you might be surprised at the tenets "rights".

        I remember doing evictions when I moved furniture professionally. By the time we showed up ALL legal channels had run their course. The eviction at that time was the last step in the process. I've evicted  clean prople and some nastier than pigs. NONE of the evictions I took part in were even Close to fun. BUT it was The Job we had at that time. ALL that was needed was the furniture and clothing and sometimes the appliance out of the residence. And off the res property. Appreciated the L E Os showing up cuz some evictions got UGLY. NEVER shot at but had knives waved in my direction and threats hurled. You HAD to totally ignore those being evicted and NOT respond to ANYTHING they said or did. NOT the easiest or best job I've ever had but it paid the bills. But That were a Long time ago. RIDE SAFE.
