    Fortunately, there were no serious injuries, but Roxie's Trike was totalled late Tuesday afternoon. Roxie was not riding, It was being ridden by our Niece Angy. A F'ing impatient 4-Wheeler passed her after his lane had ended, and ran her into the back of my Harley, and she went off the road and hit a tree. As I said, no serious injuries, but the Trike is a total loss, and I now need a new Tour Pak and the right hand saddlebag. Angy has some pretty bad looking road/tree rash on her right arm, and lots of bruises, but no broken bones. She ended up about 20 feet beyond the trike, and one of her shoes was 20 feet beyond that.

The LOW LIFE did stop, but never apologized or admitted anything, and the cops said they couldn't charge him because his car never actually contacted the Trike. Didn't matter a bit that he was in a closed lane, passing on the right.

So forget crime, sue him civilly.

Get the accident report.  Have witness write down exactly what they saw while fresh in mind.  Correct for consistency. (preparing for trial)

Look into small claims and do it yourself (sometimes the max amount in controversy can be pretty low depending on state law, but these have gone up in more recent times).  It appears FL allows small claims cases up to $8K.  Research small claims in your FL county.  Probably a 5yr statute of limitations.  Don't wait.

You file suit and have him served, he may decide to offer a settlement to avoid court... as court day approaches.  That will cost you a filing fee and service fee.

If you do decide to try this, I will happily help with advice and assistance (PM or email or phone). (free of course)

Oh man, Don! I’m really glad no one was seriously hurt.  I hope everyone heals really fast. It’s just hard to think after all that work that you had done to get the trike back in shape and then this happens! I hope something is salvageable from the trike.

 Shocked Good grief. So thankful your niece wasn't seriously hurt. That bozo needs to be cited for causing the accident for sure. I agree with earlier comments and possibly taking him to court. I bet she thought she was going to die or be seriously hurt. Prayers for her and thanking her  angel angel.  coolsmiley

Don, I am sorry to hear that Roxie's trike is totalled, but glad to hear your niece is not severely injured. Is the trike kit still usable? If so, there are a lot of very reasonably priced 1500 Wings available in Central Florida.

There are some parts that are still OK, Like the forks and triple trees, and the engine, and possibly the rear end. If the forks and triple trees are good, we will probably have Wood Butcher put them on my Neice's Aspencade, which has the Training wheel setup, and needs the raked front end. Some of the tupperware is good, but not much. I guess the seat is still in pretty good shape, too.

Wow, so sorry to hear this. So glad your Niece is Ok for the most part. Wishing her a speedy recovery. I know its a hassle but small claims court would be worth a try.
