Brentwood - CA

« on: April 06, 2023, 11:19:07 AM »

Apparently two thugs tried to steal a car from the driveway of a home in Brentwood.

The owner confronted the two thieves and one of them shot at him. As is his right, the owner returned fire and the two criminals run away.

I highly doubt this case of self defense and proper use of guns will have much air time.

Brentwood is not like SF or Berkeley. It is more rural in character, most people actually own their homes and drive pickup trucks.

I guess you can find a correlation between trucks x gun ownership.

Anyway, I hope the criminals from Oakland (most of the cases...) learn a lesson and stop visiting my little town.

Here in the free state of South Carolina, the homeowner would have been charged with Felonious Missing of Targets and then required to take a state sponsored course on how to shoot straight.  Undecided

The sheriff in our area says repeatedly for citizens to exercise their 2nd amendment rights to defend themselves without fear of prosecution. He even actually offered marksmanship training to an individual who shot back outside the house but missed. No charges filed.

That's not a right in California. My guess is he'll be prosecuted for discharging a firearm within city limits and for attempted murder.

@Flat6: but it is his right.

The driveway is part of the curtilage (https://pars.lasd.org/Viewer/Manuals/15183/Content/17729#!) and California has the castle doctrine (https://www.shouselaw.com/ca/blog/penal-code/does-california-follow-the-castle-doctrine/).

According to the castle doutrine, I quote: "... there is no duty to retreat if a resident confronts an intruder inside of his or her own home".

Now of course, the home owner may be charged if the DA is looking to get votes from people who hates guns and may incur in expenses with lawyers to defend himself, because you know, California.

even in my small rural town,  there was an almost break in thru an open screen patio door about 150 yards away from my house at night.  The neighbor woke up and he chased him away off his back patio.  I leave my patio screen open at home at night before bed, but 99% of the time I close it with the real glass patio sliding door at night.  It is safe, sort of, but not 100% safe anywhere.   My next door neighbor leaves his side garage door unlocked but locks his entrance door to his house thru the garage, but leaves the keys to the house easily in sight hanging from a nail which is too obvious IMO to do that for easy access to house.  He is more trustworthy than I am for sure.

There has been no actual thievery etc reported in our immediate community via nextdoor that I've ever seen.  Of course all the properties are several acres, all homeowners, no multi-family units or renters.  And very few unarmed residents, I'm sure.  However growth is epidemic nearby, mostly from left coast and illegal refugees.  So security/safety is sure to degrade.  I'm prepared - armed and doors/windows/cars always locked.  Adding motion-lights and cameras.

The best deterrent in my rural subdivision is a one way in, one way out access. Then the abundance of outdoor lighting, video cameras, motion lights, and fenced backyards with overly attentive dogs.

Two Brentwood's in the same state?  That's almost as confusing as North, South Carolina (population 627). Shocked

Heck, when I use to live in Richmond Hill, GA and would travel on weekends to my girl friends house in Horrell Hill, SC it was cool to take US 321 and travel through the Scandinavian parts of SC.

You know Denmark, Finland (well not really on US 312), Sweden and then Norway all the while headed North to North.

It's amazing, the stuff we learn on this website.  I never knew about the Scandinavian names in South Carolina.  Right in the middle of Rock Hill is the unincorporated area of Mexico, SC.  That really took me by surprise.

Beware of water rationing in CA. Biden is on the move to limit water in western states.

Cali could get parched.  Maybe moneybags Newsom should build some desalination plants instead of tiny homes for street junkies.

Folks around these parts have to deal with a massive crap load of that frozen white stuff every winter.  That water is ours, dammit!  2funny

That does seem to be the most sensible solution.

I don't think that even CA could drain the Pacific Ocean.

Then most politicians aren't sensible, especially those in CA.

Maybe they could Sell it as preventing sea level rise.  Evil
