Rider error...If he checked his mirrors... he failed to judge the closing speed of a driver who was accelerating at well beyond traffic flow, whom which, seemed to have no immediate indication of final speed. Until he hit the brakes and rider.

it sounds like the driver of the car was still on the right pedal while blowing the horn just before finally hit the brakes. By that time the inevitable was already happening.
