Want to know how to rear end someone on I-275?  uglystupid2 Simple, text and drive while it's raining!  I passed the guy whom rear ended me, forcing me into the back of a cadillac escalade, about 1/2 mile before it happened.  On the way home with my trusted dog co-pilot, after retrieving him from the vet to have his "boys" removed (neutered)…  Co-pilot ended up in the back seat somehow, I presume after bouncing off of either or both the dash and windshield.  Thank God he only weighs 48lbs otherwise his airbag would have deployed, almost certainly injuring him more seriously or killing him.  I'm real sore as to be expected when ones body is thrust backwards at mach 7.2 then forward when hitting said SUV, then backward at an even higher rate when an airbag made of solid steel it would appear thrust your head backwards…  Start physical therapy Monday to see what's what.  My car is estimated to cost about $11K to fix, that's before they can pry the hood open, or tell if there is any frame damage. I know the rear subframe is tweaked, can insert 1/2 my pinkie finger in the body line where my trunk lid and rear quarter panel used to line up.  The trunk lid in the picture and the rear fender don't have as much as a scratch on them, so that body line is what I believe only due to a frame being bent, but I'm not a body guy so who knows?  Be careful in a cage, be even more careful on the Fat Gurl. Thank God I wasn't on the Valk.

The "gentleman", in use of other choice names I may or may not have referred to him as after crawling out of my car is in the red jacket.  Probably 18 years old, on his dads insurance.  Which isn't enough insurance to cover my car alone, let alone the escalade. What an awesome mess, anybody have any insight on dealing with an insurance company to get "diminished car value" after an accident?

Damn that SUX!!!  Why didn't the passenger air bag deploy?  The dog didn't weigh enough and the car thought the seat was unoccupied?
He is on the side of the road still with his phone in his hand....  His passenger must have hit their head pretty hard on the windshield to put a hole in it.... air bag sticking through the hole.

You might have to claim it on your insurance, if you have un-insured/under-insured motorist coverage.
But, it SUX either way!

Most new cars, if not all, have a weight sensor in the passenger seat. I believe it's 50-60lbs for it to arm the passenger airbag.  The idiot that hit me didn't have a passenger!  I couldn't believe it either but the tow truck driver informed me that 99% of the time the passenger airbag goes off the door on the dash that covers the airbag goes trough the windshield.  Lets you put in perspective how fast things are moving when that bag deploys…

My insurance is footing the bill and will apparently go after his insurance for whatever they can recoup.  At least my car is going to be fixed or totaled once on the frame machine. A hit from the rear at 40-50 and add being sandwiched I would have to believe something is bent somewhere... Angry

Glad you and man's best friend are fairing. Document everything.

Same for myself Kyle, on Himes, dead stopped at the stoplight behind Walmart, September; lady hit my F250 4 door long bed V-10 at 45 mph.....I made sure she was alive, only shaken but her doors were done.
first she said the sun was in her eyes.......... With LEO standing beside me, she then admitted she was texting; and was cited, with several offences.
Then insurance company said my truck was totaled...told them no way unless they were going to give me 54 grand for a new truck, not my truck, it's my company's. Have to have it.
Told insurance court wasn't going to be pretty and her cell phone records would reflect as such. My truck was repaired ok, 13 and a half grand in repairs, only offered to give me 15 grand for total...book value. I should have taken an ambulance ride, that would have been worth 50 grand and future med bills according to Hoyle.....Lucky for her I had a planned MC ride the next morning or things might have gone a different way....ohhhh the pain, soft tissue trauma, whiplash, one ball is hanging lower than the other, etc....I'm just not sue happy. If it was me doing the deed I would be sued toast, I'm sure.
Little Toyota's shouldn't mess with full sized trucks. The Texting has got to stop while driving!

Well, thanks for that update John.. Grin

James is right though...This whole distracted driving thing has got to be stopped somehow. Watch at traffic lights how long it takes some..many actually, to start moving after the light turns green. Why? because the SOB's are doing something else, probably texting or dialing. It used to be the occasional issue, woman putting on make-up while driving to work, eating something that requires two hands, etc. Now it seems there are so many folks doing some other activity while driving. Our risk om two wheels has gotten even higher now I think. Legislation is the only quick and reasonable solution. It has to be serious and expensive to be effective. Many Cops I know though say they just don't want to stop someone for doing it..they already have to much to do and will ultimately end up in court proving what they saw. I don't know, kind of scares me.

Sorry to hear about your accident.
How do you know the guy was texting at the time of the accident? Curious.

Embarrassed  Well John, was quoting in bold really necessary....lol

Florida statute Chapter 316 section 305 went into effect October 1, 2013 and creates "Florida Ban on Texting While Driving Law". This does not cover actual voice use and can only be sited as a secondary violation. This means LEO isn't going to light up even if they see you texting.....kinda ineffective law I'd say, might just as well throw in the lipstick, makeup and hair prep law; not preventing anything. Distracted driving is the same thing, also a secondary offence.
My incident occurred September 20, 2013 and the driver was sited anyway as well as careless driving, and two other moving violations.
Remember when you had to go to a phone booth to make a call if you were on the road? A vanity mirror was an option for the passenger side only. Could not be factory or dealer installed in driver side visor. Yes, we all advanced; several steps backwards....sometimes.

I KNOW he was either texting or on Facebook or whatever he was doing because I passed him about 1/2 mile before he smacked into me. I even called him an idiot and shook my head at him because he was swerving all over the place!  My lawyer is pulling his phone records...
