So this morning I am minding my own business riding down the Grand Concourse in the Bronx.  Its 2 lanes each way with a yellow stripe as it goes under Fordham Rd.
The other 2 lanes each way are the "local" road so the local lanes go up to the grade for the Fordham Rd part

As you come back up there is a grade crossing with a traffic light  I am in the left lane a car is to my right  Traffic is moving at a whopping 25mph in the 30 zone.  

A police cruiser has pulled illegally across the street and he is stickin a bit out into the right lane which naturally has a car in it as well as into the service lanes So the car to my right not wanting to broadside the cop who by the way did this in spite of the red light against him, because he can, starts moving into my lane

I did what anyone should do  HIT THE AIR HORN  The car next to me refrained from forcing me to head on into oncoming traffic

The police cruiser had neither lights or siren on and as I drove on he did not move

I thought to myself glad I was not splat and he should know better

Ten streets later there he is behind me and he pulls me over

License Reg and Insurance he demands  His partner with his hand over his sidearm

Tell me the reason for the stop I reply

Give me the license etc and I will tell you  Since I have to be in Court in 5 minutes I gave him the papers as I stood over my trunk (I keep the ins card taped to the inside of my trunk)

He says you are not wearing goggles and your face shield is up and writes me a ticket that takes 20 minutes.

Now officer I am wearing a DOT helmet and ANSI approved wrap around safety glasses, the kind that a steel ball bearing can hit at 60-mph and it wont shatter. These are all legal in NYS. If I dont want to use the visor I dont have to and if I had a half helmet there would be no visor at all.

Now I looked up the law when I got back to work and NYS V&T does say you need a visor or goggles or such approved by the commissioner of motor vehicles. Next stop is the office of the commissioner as I will have to inform the police commissioner that he must ground all his officers inHIGHWAY 1, 2,3 and 4 in NYC as NO OFFICERS ON BIKES WEAR GOGGLES, anywhere in this state.

Now I did tell the officer after he wrote the ticket that I know the reason he pulled after me was because he almost caused my demise and that I would see him on the return date.

But be warned if you ride in NYS that the law on the books is as F'd up as everything else here. I will post how I do with the commissioner after I try to get some answers from the MSF people/

Valker have you got any info for me on what is acceptable to commisioners in NYS for eye protection?

Hey Oss, Use the officers ID info, name & badge number which should be on the ticket and file a complaint with his superiors regarding his traffic violations.

Oss, I may be reading the NY regs incorrectly, but I think your windshield does not qualifiy as eye protection. Here is the stated requirements for eye protection devises (EPDs) for NY: http://www.vesc.org/Media/VESC%20V-8%20Minimum%20Requirements%20for%20Motorcyclists%27%20Eye%20Protection.pdf

"All motorcycle operators must wear approved eye protection even if the motorcycle is equipped with a windshield.  Any windshield must also be of an approved type.  Prescription or made-to-order safety glasses may be used if the user can present written certification that they meet DMV standards.  The eye protection must be manufactured in conformity with the regulations established by the American National Standard Institute (ANSI – Z87.1).   However, the DMV recommends approved goggles or a face-shield for full protection."

I will go to the lumber yard where I buy my glasses and have the owner who is my friend give me a label from a pair I know these are ANSI approved as I have been buying them since I got my license in 2001  

You ever try to put on a full face helmet while wearing goggles?  I cant do it. RJ when you were a chip did you have such nonsense?

The eye protection must be manufactured in conformity with the regulations established by the American National Standard Institute (ANSI – Z87.1).

Just so you know... ANY safety glasses that are listed ANSI Z87.whatever have Z87 stamped on the frame somewhere.  (I spend way too much time on oil platforms!!!)

Bring you glasses with you when you go talk to whoever you're going talk to and show them the stamp.  There's your proof... no paperwork needed.  THEN, file a formal complaint about the illegal move the officer pulled in front of you.  They'll probably only slap him on the hand, but at least it's on his record.

The Z87 will likely be on the inside of the frame on the left or right side. If it isnt there, a sales tag wont do you any good.
