As hard as it is for me to say this.  I am glad we got him back, he is an American.  He and his father have the right to feel and believe what they want.  I served to protect that right and even if I dont agree with someone I still defend their right to their beliefs/feelings.  However, as a uniformed military member he should have to face the consequences for his actions.  

It is disgusting how this administration picks and chooses which laws to follow and how they choose to get involved in a crisis only if it benefits their agenda.

We really need to keep the pressure up to hold this "president" accountable.  Hey, there is plenty more room in Guantanamo now.  He could get his own private wing

Exactly how I feel.  I was one that thought he was captured through combat and not until a couple of months ago found out about the walking out of the area.
Glad he will be back, but needs to be prosecuted for his actions.

The timing is very "Wag the Dog" suspicious...

Obama was getting hammered by the VA murders, the weekend news cycle would have been nothing but how big government run health care DOES have death panels, and there is a body count attached to it, after the "resignation" of Shinseki. Suddenly, a feel good story comes out at JUST the right time to make the talking heads talk about something else entirely...

I will wait for the full facts to become known. (so should everyone) (it'll take awhile)

If he is charged, it will be with what can be proved.  

Most AWOLs only get an Article 15 (but most are only a few hours, days, week).  Desertion in the face of the enemy carries, Death or such other punishment as a court-martial may direct.

Zero can put his thumb on the scales; he is the chief convening authority for all Military criminal law. Military courts are not Article III Federal courts but derive from presidential authority (Art I).
(and he can always pardon.. anytime)

But I would expect this to play out like any other military investigation, until and unless he does.

Desertion in time of war has some serious consequences. I'm happy he is in CONUS but seems to me there are a lot of questions on both sides of the fence here. With the current potus making up the rules as he goes along how much longer can we put up with his BULLSHIT????? And zackly WHEN did it become alright to negotiate with terrorists? Face it this is win win for Obama.  Like said above, tones down the VA debacle, sets a precedence to empty GITMO, gets him out from under the shadow of military tribunals for these dirtbags,  aids and assists the enemy, he has already armed them now he is sending them some new leadership.  Emboldens the enemy to take more prisoners to use as bargaining chips, maybe the blind sheik next.  Does anyone really believe that he is not a closet Muslim????   There is absolutely no level too low for this scum to stoop to achieve his agenda.   Also don't forget the Benghazi thing was heating up again, and he absolutely cant have the truth come out about that.

IMHO, there is NO WAY there will be any charge, much less prosecution.  After making a big deal out of it, having parents on the WH lawn, and taking the heat for releasing the worst of the worst terrorists, there is ZERO chance that he will be brought up on charges!

no problem O2S. Not trying to stick up for Obama, just trying to keep things in perspective. I personally don't know if it was the right thing to do negotiating for his release. But I do know if they didn't and the Taliban broadcasted his beheading, EVERYONE would be all over his ass for not getting that kid out of there.

"Forwarded from Jeff Howard. "We were at OP Mest, Paktika Province, Afghanistan. It was a small outpost where B Co 1-501st INF (Airbone) ran operations out of, just an Infantry platoon and ANA counterparts there. The place was an Afghan graveyard. Bergdahl had been acting a little strange, telling people he wanted to "walk the earth" and kept a little journal talking about how he was meant for better things. No one thought anything about it. He was a little "out there". Next morning he's gone. We search everywhere, and can't find him. He left his weapon, his kit, and other sensitive items. He only took some water, a compass and a knife. We find some afghan kids shortly after who saw an american walking north asking about where the taliban are. We get hits on our voice intercepter that Taliban has him, and we were close. We come to realize the kid deserted his post, snuck out of camp and sought out Taliban... to join them. We were in a defensive position at OP Mest, where your focus is to keep people out. He knew where the blind spots were to slip out and that's what he did. It was supposed to be a 4-day mission but turned into several months of active searching. Everyone was spun up to find this guy. News outlets all over the country were putting out false information. It was hard to see, especially when we knew the truth about what happened and we lost good men trying to find him. PFC Matthew Michael Martinek, Staff Sgt. Kurt Robert Curtiss, SSG Clayton Bowen, PFC Morris Walker, SSG Michael Murphrey, 2LT Darryn Andrews, were all KIA from our unit who died looking for Bergdahl. Many others from various units were wounded or killed while actively looking for Bergdahl. Fighting Increased. IEDs and enemy ambushes increased. The Taliban knew that we were looking for him in high numbers and our movements were predictable. Because of Bergdahl, more men were out in danger, and more attacks on friendly camps and positions were conducted while we were out looking for him. His actions impacted the region more than anyone wants to admit. There is also no way to know what he told the Taliban: Our movements, locations, tactics, weak points on vehicles and other things for the enemy to exploit are just a few possibilities. The Government knows full well that he deserted. It looks bad and is a good propaganda piece for the Taliban. They refuse to acknowledge it. Hell they even promoted him to Sergeant which makes me sick. I feel for his family who only want their son/brother back. They don't know the truth, or refuse to acknowledge it as well. What he did affected his family and his whole town back home, who don't know the truth. Either way what matters is that good men died because of him. He has been lying on all those Taliban videos about everything since his "capture". If he ever returns, he should be tried under the UCMJ for being a deserter and judged for what he did. Bergdahl is not a hero, he is not a soldier or an Infantryman. He failed his brothers. Now, sons and daughters are growing up without their fathers who died for him and he will have to face that truth someday."
