Eric Garner case was settled for 5.9 million dollars, why? To me it seems that if Eric in his life time had ever earned that much it would be a pretty amazing feat. Now his family gets to live in a style they had not been accustomed to. A change in NY law cases now giving the attorney general the right to prosecute cops that the city sees as stepping over the line.  Eric's lifestyle does not reflect a fine upstanding citizen so we reward bad behavior. I don't think Garner should have died but I also don't think with his record his family should have been rewarded with 5.9 mil. There are many articles on this case pick the one you want to look at but how ever is there justification of 5.9 mil, Really?

If he had earned 50k a year for 10 years that would have been 500k, with his lifestyle choices and health issues I doubt it would have been much longer than that.

Garner had been arrested by the NYPD thirty times since 1980 on charges such as assault, resisting
arrest, and grand larceny. An official said the arrests include multiple incidents in which he was arrested for allegedly selling unlicensed cigarettes. At the time of the incident, he was out on bail for selling untaxed cigarettes, driving without a license, marijuana possession, and false impersonation.

Robert it makes as much sense as giving a terrorist state
150 million or billion just because they say "oh we wont kill today"

Unfortunately there is always more to it than "earning potential".  There were and are many factors that go in to determining the settlement amount,  the keyword is settlement.  Consider potential attorney, legal and court fees, fees for witnesses, time involved,  mental anguish, pain and suffering, punishment for the city employees going against their own policy, failure to render emergency first aid after he stopped breathing.......it was all on video, played over and over.  The price of a mans life is just not what his earnings would have been, or could have been, it has to be worth much more.

We could all be worth more dead than alive.......n

Oh and if there was a change to the law permitting the attorney general the authority to prosecute, it could very well be an attempt for them to recoup the tax payers losses in cases like this where the officer or officers went over the line.  My theory is....that won't happen, and it was only changed to make it look good for the public, and maybe to give some kind of notice to those officers that get carried away.

I think the real crime is that it's a crime to sell a few cigarettes on the street corner.

The settlement is the worst thing that could happen to the family.  Just read about lottery winners who hit it big and were broke within a few years after the family unit is destroyed by infighting.

That was my thought exactly.  They will never see most of this money anyway between legal fees and taxes. I hope what remains is intelligently managed but like Rainmaker believe there's a good chance it will just evaporate leaving discord in its place.

Money causes more problems than it solves. Especially for those who do not know how to handle it.
That would be the case here.

Thank God the NYPD is spending their valuable time and resources on the violent crime of selling untaxed cigs.  Roll Eyes

When the cities new ultra liberal mayor wanted a crack-down on the sale of loosey's it appears to me they were doing what they were recently told to do.  I seriously doubt much attention would normally be paid to such activity.  Plus, with Garners previous arrest record I think he would be looked at more closely than most people.  Had he complied he would probably have been released so he could go and continue to sell his loosey's. I doubt the lame stream media released any of this info.

are you serious  upset its a crime to sell unlicensed cigs

Remember someone named Al Capone   People liked him too
He sold booze without tax stamps  yeah it was during prohibition ok   Wink

if something happens in front of a cop and you dont heed his warning and
act all smart mouth nothing good will come of it

I dont particularly care for the whole affair

Selling illegal cigs, dope, bootleg booze it doesnt matter

You reap  what you sow when you break the law

My heart does not go out to the dead guy sorry  and whatever color he was who cares
It goes out to the cops who now have to defend their own lives

Dem council and mayor put the law on the books, so they would get more money to spend. If u dont want a law inforced, dont pass it! Dont blame the cops for doing what they have been ordered to do.

Just in case anyone missed the main points of Garner;s rap sheet and why he would be treated a bit differently or harshly

Garner had been arrested by the NYPD THIRTY TIMESsince 1980 on charges such as assault, resisting
arrest, and grand larceny

he was OUT ON BAIL for selling untaxed cigarettes, driving without a license, marijuana possession, and false impersonation.
