Tenant in apt more than 364 days get 30 day notice
up to 2 yr 60 day  over that 90 day notice (3 full months from end of current month)

BEFORE you can start a Holdover

for Non Payment it is worse
14 day (+5 for mail) rent demand
Start case tenant get 3 free (no rent) adjournments average 4-8 weeks each one
Cant refuse to rent to tenant because they were in court before
only 1 month security

Judge can give 1 yr to move after you win

Governor Cuomo is a boil on the ass of the state of New York
The Democrats have just started a process that will make the Bronx is burning look like a little thing

Small Landlords will not survive  I have been counseling clients to sell and hope they will listen and get out while the prices are still high

How can you pay mortgage and taxes if the tenant does not have to pay their obligations????

The law is 72 pages single spaced and took effect immediately before anyone could read it who was not in the legislature

That is a crock of sh!t.

It should be attacked in the Courts as an unlawful taking under 5th Amend.

While the tenant gets the benefit (of possession) of the taking , the Govt is forcibly taking property (rent) from the landlords by operation of law.  It is confiscatory and wrong.

I would never be a landlord for any reason.

communist UN 2030 Agenda control of all.  state/cities want control all of the apartments/rentals, to put their illegal immigrants there and get massive Fed money to support them.

Similar things have been going on in NYS for quite some time. I was once a landlord. Our system is completely against the owner and I finally got fed up with it [ just before going bankrupt, almost] and sold the apt. houses. Its amazing what some people think they are entitled to, and, our system agrees.

yep, selling two of my rentals right now. third one keeping for now family member rents it.

here in NJ, if a landlord takes a renter to court for non-payment eviction and if the renter filed for bankruptcy before the landlord filed for eviction, then the renter cannot be evicted and cannot be forced to pay.  So the only option the owner/landlord has is sell the property with them still living there and then new owner can evict them, or owner stops paying mortgage, defaults, sheriff sale etc. However the renter gets to live there rent free all of those months possibly years in both cases.

One college kid broke his hand trying to punch thru the wall, so, rich Long Island daddy sued me. They lost and I refused to rent to them after that. Then they wanted to play nice and pay the full year and any deposit I wanted up front, I wouldn't go for it.

I've got a cousin living here, that when my MIL is not here any more (and if he is still here) such that I've been considering the same idea for broken drywall repair. Also considering putting exterior grade solid wood or steel doors inside for the same reason....

Would putting locks on a door that the tenant doesn't have keys for, for the purpose of locking them out of their apartment, be illegal in this scenario ?

And why didn't the legislature protect the landlords by suspending payments to mortgage holders and the municipalities while the tenants aren't paying under this law ? Or how "difficult" is it to just hand over the apartment to the mortgage holder ) and let them become the landlord ?


Ok - now I have rented apartments in the past, and it was definately a better situation to use a company running a complex over a "small" private landlord renting a small number of apartments.

You are correct.

As soon as you save all your money to buy a 2 or more family dwelling you are a rich capitalist and the avowed socialist DiBlasio and his minions are out to milk you out of all of it

This is a cold hard truth.  It really pains me to say that but it is fact

Locking someone out after he or she has been in premises 30 days is against the law. Police are not there to protect any Landlord. let alone a landlord with an Order of Protection sad as it is to say   They are there now to follow orders and clean up crime scenes, write tickets for going 30 in a 25 zone, serve warrants and make arrests while they drive with their phone glued to their face  It pisses many of them off that they see people smoking dope they just walk by them.

If your life is in danger they are NOT there for you, those days are over and I have friends on the force who tell me so.

Also can not use a handgun in nyc without the impossible carry permit (unless you are an elected official)

While I am in Court my daughter knows that if she yells the Yemeni merchants will storm across the street to come to her aid and they have done so recently when a crazed man refused to leave my waiting room. (Probably doesn't hurt that I never charge my neighbors for simple legal help and always ask how their families are doing. It is of course "Mr Rogers Neighborhood"   Wink)

Wow, what a difference. I just renewed my carry card. It’s good gif handguns, knives and billy clubs. I rarely leave my house without my legally carried full sized .357 revolver. As long as my life is being threatened I can shoot to kill and it’s totally supported by law enforcement

NYS is doing its best trying to eliminate all guns and shooting sports. Some of the shooting clubs have started high school programs showing the kids proper gun handling and trap and skeet shooting. It is well received but Albany is sticking its nose in and making it as difficult as possible for us to continue.

There was recent arrest in our small town for the shooting of a man that broke into a home and was shoot by the home owner on the 2nd floor stairway. 

One thing I didn't want to do and fought it as long as I could was to turn in my downstate carry permit once I retired. NYS recently started a handgun permit renewal system which tells us they are doing their best to eliminate hand gun permits throughout the state.

I'm impressed at the amount of shooting sports facilities in Florida. Shooting is big in that state, its pricey though for a round of skeet/trap.

Its funny how the subject of these posts change so quickly.
