I just don't get it. A pregnant woman manager was fired from a fast food restaurant after being robbed at gunpoint. The company wanted her to pay back the money that was stolen out of the register. She had previously been reprimanded on more than one occasion for leaving too much money in the register, if she had followed procedure the river would not have gotten several hundred dollars.  It was publicised on the news, and she was given her job back with some extra money. She is now demanding 5.5 million dollars for emotional damage. and reports to work tomorrow at the same time changing but a different store.

She says no one cared that she had been held at gunpoint, focus was on the money they wanted paid back.

I understand her being upset.  I also understand that she had been told more than once that she needed to do cash drops, and if she had done so, the store wouldn't have lost so much cash.  Firing her was the store's right, rehiring her was to protect their reputation.  But 5.5 million?  I suspect her lawyer called her to propose the case.

Before my daughter quit her job at a large chain women's clothing store,  the mgmt. felt it was not necessary to even install security cameras in the store.  At least twice my daughter told us in the almost 1 year working there part time that she and the other co-worker knew the people coming in and saw them walk out stealing merchandise.  I guess the store's policy is to say NOTHING and let them walk out the door.  Nice warm, fuzzy, safe feeling working there?   uglystupid2

I'm not one to sue for millions even if the firing of a worker was unjust, but sometimes that is what it takes for some to get rich quick.  When a young lady with small child and barking dog in tow ran a stop sign doing 3 grand in damages to my dad's caprice with me driving,  my mom in the backseat got whiplash and her neck hurt for a few months.  The young ladies insurance company kept near weekly asking if my mom was o.k. on the phone, almost to the point of being harrassing, but in a nice way.  Mom eventually went to the dr. and found out nothing was out of the ordinary, just whiplash and will heal in a few months or more.  I think my mom only got about 4-5 grand in injury compensation and the insurance lady over the phone thanked her for not asking for 100K or more as most would she said in today's world, being fair and honest.  

A lot of people today want to make a fast buck (million) by sueing others insurance companies.   A fellow co-worker who quit told me he was sueing this older, rich lady for millions and right before he left, he told me he will get rich quick being a millionaire soon.  Did not know details nor did I care to ask since didn't care, but I bet it was a fishy claim knowing the type of person he was.   Thus, one of the main reasons on why insurance nowadays cost so darn much.   tickedoff

The vast majority of these nuisance suits, settle for far less than asked for in the complaint, and for less than it will cost an insurance defense firm to prepare and defend a full jury trial.  Insurance companies mostly farm out their litigation to private firms, and a healthy part of all our insurance premiums goes to paying those expenses (above and beyond the actuarial risk we will damage our own or others cars).  And when settled, they virtually always have a no-comment confidentiality clause.  

What this used to mean was you could get at least 15-20K just by filing a barely arguable nuisance suit (crap, but enough to beat a summary judgment motion and get to a jury).  It's probably more now.

When you hear the term bottom feeders.... this is who they are talking about.  

Of course the irony here is she probably has a better chance of winning (a settlement) after the company showed heart and hired her back.  The termination was likely righteous, and had they stuck to it, her chances of winning a settlement would have been poor.

On last night's news they interviewed the lawyer.  He said the suit he files will not have a dollar amount attached, the 5.5 was just to get their attention.
