You really can't keep the court at 4/4 that long. There would be no rulings.

The President has every right (PER THE CONSTITUITION) to select Justice Scalia's successor.
By tradition - he usually selects someone with the proper legal background who gets an endorsement from an association of Lawyers on the qualifications of the proposed candidate .
Then it goes to Congress for confirmation. (part of that Checks and balances thing).
I think it would be a BAD THING to let this hang until the next president has been seated.
The fact of the matter is that Obama knows that a too far left leaning Justice wouldn't be confirmed anymore than Bork was - he (/she) might be left leaning, but not an extremist.

Kind of interesting O has taken a beating in a few decisions in the Supreme Court, immigration and EPA guidelines among them and now a conservative Justice is dead, No matter what judge is put in there may be favoritism to the current admin just like Holder or the current head lawyer. Kennedy anyone?

I'd kinda like to see who Obama would appoint to the position before I would pass judgement on the selection.
To toss someone in there just to pick a fight would not sit well with anyone of any political persuasion.
As to the Hillary Clinton conspiracy theory that she would chose Obama if she becomes President and they are going to wait because of it, the reality is that the Court is very likely to lose at least a couple more during the next Administration.
My guess is that we can expect a well qualified slightly left leaning centrist as Obama's pick and the Congress will approve quickly. The pick will neither be conservative enough for the right nor liberal enough for the left but eminently qualified for both.
Got no idea who it would be. OOOOooo the suspense!

If this goes until next January when Congress is out and before Obama's term is over then we may have this to look forward to;
Article II, Section 2 of the U.S. Constitution provides that:
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.
Thus, when the Senate is in recess, the President may make a temporary appointment to any office requiring Senate approval, including filling vacancies on the Supreme Court, without the Senate's advice and consent. Such a recess appointee to the Supreme Court holds office only until the end of the next Senate session (at most, less than two years)

I agree. As long as they call hearings and have a vote that is all they can do. If they vote the nominee down they vote the nominee down. Where it would become obstruction would be if they don't call a hearing and won't vote. Which is the direction they seem to want to go as of now. We shall see.
