This is a big if, but IF Obama's Mom was in those pics. They were private pics not meant for profit. Melania's were public . Surely you can see the difference between someone knowingly, willingly do public pics for money and someone doing a pic in the privacy of their home between them. And having them stolen and put out for the public.
Like I said, it's doubtful they are even her to begin with.

I'm sure it does. For a simple layperson as myself, I would consider if it was in a magazine or any advertising it was on the public domain.

Melania definitely had those pics taken, and definitely wanted them seen by as many as possible. Obama's mother didn't have those pics taken and did no nude modeling. See the difference ? The (disputed) pics of Ann Dunham were published in several magazines.

Whether or not they were originally intended to be private this would place them into the public domain.

Futhermore, since there were at least 3 people present when they were taken they were never really private to begin with.

Example: If a 3rd party is present while you are speaking with an attorney then attorney client priveledge no longer applies  .



One other thing, the picture that you got your dander up over was and is a joke.

If you'll go back and look at it, you will see that it actually never shows the "Private" parts of either woman.
