After nearly a dozen gun-control bills were passed following Democrats taking complete control over Virginia’s legislature in January, the feared gun ban is finally here.

The Washington Examiner’s Paul Bedard has the scoop: In a 12-9 vote, the House Public Safety Committee voted to ban “assault weapons” such as the popular AR-15 and AK-47, magazines that hold more than 12 rounds, and sound suppressors, effective July 1.

The bill is expected to win passage in the full House of Delegates but faces some difficulty in the Senate, where a handful of Democrats are unsupportive. A similar bill in the Senate was previously withdrawn.

Gun advocates flooded the committee hearing room and were cleared out after the vote when there were some angry reactions. The legislation was amended so that those who own the banned weapons would not have to give them up or register them, but the ban on big magazines and suppressors would stand.

Previously there was no plan to grandfather in current “assault weapon” owners, but perhaps the logistical impossibility of confiscation without a gun registry caused Virginia’s legislators to re-evaluate that. Virginia’s Governor Ralph Northam also previously expressed an interest in expanding the definition of what an “assault weapon” is to include most handguns and shotguns. There’s no reason to believe that he’s changed his opinion on that, even if it hasn’t been enshrined in legislation thus far.

Feel sorry for you Virginians as the $hit for brains in charge of their legislature and government don't realize it is not the instrument it is the miscreant that wields it

Why does their Court system not enjoin enforcement of the law or declare it unconstitutional under US and Va constitutions?

Well, the VA capitol police aren't going to let any protest inside the capitol disrupt the assembly (or committee), no matter who they are or what their point of view.  It's about all they get paid to do after all, and refusal would mean fired by close of business.  

I think a lot of real VA policemen are not in favor of these laws either, but I'm afraid most (rank and file) are afraid to talk about it, publicly anyway.  They have families to feed and bills to pay like everyone else.  Remember beyond department duty weapons, all these laws equally apply to serving police officer's ability to protect their own families (they are not exempt).  

More sadly, not only am I losing 2d A rights, I'm also losing 1st A rights, and believe I can no longer freely express my opinions on social media about this situation going forward.  Lips Sealed Cry

Sadly, my county would not be invited to join WV, in any event.  Even I would strongly recommend against it.  WV is my actual home state (from long ago), and I could never do that to those good people in my own interest.  

One might reasonably feel a certain kinship to one's longstanding domicile, after almost three decades, especially when so many kinsman are working so hard and fighting the good fight.  And there's a level of extreme distaste in letting the bastards drive you out of your home (and state) without a fight.  And with any luck this draconian push might be just the ticket to retake the legislature (at least one house would ensure no further sacrilege).  But with a seemingly extreme uphill fight to retake the governorship, and little chance of the numbers to ever override a veto, the chances of walking any of this freedom hating legislation back is not good.

So we'll see how things shake out, and maybe we won't have to move to an actual freedom loving domicile.  I have started over in my life (and home) so many times, and I had hoped to be done with that in my old age.

The mountain will not come to Mohamed, so he may have to go to the mountain.

The only way those abomination of laws will get overturned is by a decision at the Federal level. Maybe even a Supreme Court one.

It's possible they (or some) could be won at the state level, as VA has a nearly identical 2d Amendment.  And some decent judges.  There is some forum shopping to be done state and fed, by those that know.  

Just one of multiple problems with winning by litigation (besides time, money and continuing appeals) is that you generally cannot challenge a whole bundle of laws and regs all in one litigation.  So there's the case on confiscation (all or some), the case on registration, the case on mag limits, the case on red flag law, the case on mandatory FFL transfers, the case on loaning a firearm to your son or dad, etc.  

It only took around 200 years for the Supreme Court to find the 2d A guarantees an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home. District of Columbia v. Heller, 554 U.S. 570 (2008)   Course, no one doubted this or needed to go to court on it for most of that 200 years.

If the NRA doesn't immediately stand right up to the plate in their own state with the best legal talent and full court press they can muster, they can kiss my....foot.

Of course, just another fun fact is that those of us Virginians who will stand up and support such litigation with money (whether the NRA, GOA, or whoever, or all of them).... will also be funding all of the legal defense of these rotten laws though our general revenue VA state taxes, which are not likely to be going down any time soon with our new democrat trifecta.

We're not the first state to go thru this, Cal., N.Y,  MD some of central states have worse gun laws then we do.  The first bill submitted got shredded of a lot things they are trying to do, so some of Dem. are against some ot the laws they want to pass.  Bloomburg funded this drive and our  Gov. dove right in.  So don't think this can't happen in other states, one at a time.  If Trump is all for the 2nd amendment why hasn't he stopped these attacks on them?  Why did he just extend the Patriot Act, when it was ready to expire....Sometimes I believe there is more going on here that needs to be considered...my county Tazewell will probably be the target county because we are trying to raise a Militia, not for a fight, but because a well regulated Militia gets to keep their firearms.. cooldude

I'm sure you've noticed that (just) one of these pending bills is trying it's best to outlaw any militia activity (or is it purely first amendment speech activity?).

I live in Ky. very close to the Va. border and do a lot of business in Va. I will stop shopping or spending any of my money in the Communist State of Va. I still have to go thru there but will only use their facilities to stop and take a dump. No more buying gas or anything else in Va.

You forgot to mention NJ with some of the worse if not the worst gun laws.  Our governor is an extreme lefty with all his north Jersey Democrats ready to pass any gun law that can be dreamed up. I fear the end result that is spreading like a virus in some of the states that were once pro-second amendment, like Texas and Colorado.

The Virginia Supreme Court struck down the law in 2005, so removing the (long unenforced) statute from the books is a mere housecleaning move.  Real important work there.
