The lawyer hired a accident reconstruction firm to look at the accident. THEY said the truck didn't cross the center line and the lead HD was over the line on the curve. If true, how did the driver loose control and the trailer get on the wrong side of the road.
It will be interesting to watch this go to court.
I as I read the article it was the State that disclosed the report of the independent accident reconstruction firm, not the defense. The defense did make the motion based on the disclosed report.
The report says the impact caused a catastrophic air loss in the left front tire. (My assumption is they are suggesting this was the cause for the loss of control after initial impact.)
I remember the day this happened and seeing the report on it. I believe at the time I stated that I was going to hold my judgement on this till the facts came out. Apparently they are still coming out.
I guess my view is that being I ride, and I have been on a number of Poker Run type events and such, I've seen on many occasions, groups of bikers head out drunk and with reckless abandon.
As to why I would consider this in this particular case is that the initial impact occurred on the center line of the road. Even if the truck was slightly over the line and the driver under some kind of influence, why didn't the lead cycle move to the right a foot or two to avoid the collision?
The lead cycle was on or very near the line and possibly over it.
In any event, let the facts come out.
