Yep that's the way it's done. That road even has a rumble strip on the shoulder...don't know how they drifted all the way over into the guardrail.

Our Vol Fire & Rescue Dept responded to one almost exactly like that less than a month ago, the difference was the rail entered the left headlight, through the cab & the driver of the pick-up and out the tailgate, Had to cut the rail in two to get him out. He did not survive. Witnesses said it looked like he was a sleep when he passed them. Only good thing is he didn't take anyone out with him!

Sleepy Drivers are considered more dangerous than drunk drivers. Connecticutt passed a law about driving without proper rest. Texting and driving is probably more insane though. With the society we live in, it is a problem. AL

Using a mobile phone (cell) whilst driving has been made illegal here in Australia for some time now not sure what the fine is but a guess would be about $250 as it is $280 for not wearing a seatbelt

We had a Blazer spin out on the interstate a few years ago. Went along the rail. It peeled back the entire passenger side from front to back. Luckily he was not wearing a seat belt.
Crotch rocket guy hit a gaurd rail once. Up here we have steel I beams to hold the gaurd rail unlike them 4x4's in the pic. I could count each upright his left leg hit due to the meat on each post. Took us 6 turns to unwind his leg.

They keep saying that using a cell phone while driving is just as dangerous as drinking and driving but the penalty doesn't fit the crime. In California it is a $20 fine if your caught using a mobile device (without a hands free feature). With such a severe penalty it is little wonder that no one obeys this law. Most states seem to have just a slap on the wrist for cell phone usage while driving. Here in Nevada I see law enforcement officers driving all the time while using a cell phone. I have been thinking about an illegal jammer.

I am not a fan of more laws. Laws don't stop anyone from doing anything. Driving fast... drinking and driving, doing drugs, or criminals from having guns. Personally, I think the cell phone people should lock-out the texting and dialing options, without voice recognition when moving. Just like a lot of GPS's have. Jabba

Jabba Amen to that, It is legal to pull a person over in Florida for not wearing a seat belt. That means LEO's can pretty much pull over any car they want. Way to many laws to protect society from stupid people, As far as I can see most don't work.

Jabba ding,ding,ding we have a winner! dont we already have 'distracted driver laws'? that should cover anything from whacking the kids in the back seat with a flyswatter to texting. CDL drivers are now have a final rule on texting while driving fines can be up to $2750, needless to say I'm not going to text and drive  I also heard they've done a study in states that have 'no texting laws' and people are still texting in a more dangerous position by holding the phone down low so they don't get caught. that averts thier eyes farther from the road and is ultimately more likely to cause a crash.
