Raw milk enthusiasts and raw dairy suppliers began fighting back in early 2010, filing suit against the FDA, claiming that banning interstate sales is unconstitutional.

The rebuttal received from the FDA was shocking to say the least.

It contained the following outrageous statements, which make it very clear they believe you have no right to natural, unadulterated food:

"There is no absolute right to consume or feed children any particular food."

"There is no 'deeply rooted' historical tradition of unfettered access to foods of all kinds."

"Plaintiffs' assertion of a 'fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families' is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish."

The FDA's brief goes on to state that "even if such a right did exist, it would not render the FDA's regulations unconstitutional because prohibiting the interstate sale and distribution of unpasteurized milk promotes bodily and physical health."

"There is no fundamental right to freedom of contract."

With these assertions, the FDA essentially claims to have the authority to prohibit any food of their choosing, and make it a crime for you to seek it out.

This is simply unacceptable. "

The best cheese I've ever tasted has been in France and Spain made from unpasteurised milk. Both cow and goat cheese. From small local cheese producers.

FDA tickedoff   Dont usually agree with your stuff but this one I have some personal knowledge and you are on the money

IMHO.... fedz in the pocket of special interests only



These folks will shut anyone down based on what big biz agenda wants


Will be curious to see what the TEA PARTY platform is on the FDA for 2010 elections
as the dairy farmers and regular farmers need to know this real soon

Wow, having been born and raised in Iowa, and having consumed untold gallons of fresh milk kept nice and cold in the well house.....I can tell you from first hand experience; the FDA has their collective heads where the sun doesn't shine. I agree Oss, they're bending to big business bucks. I can remember as a kid helping do the early morning milking, hadn't had breakfast yet and was hungry. My cousins and I would take a cereal bowl to the barn with us, scoop up a bit of the soybean meal for the cows, grab a teat and give it a good shot of warm milk....same as when you pour it from a gallon jug from the store. Sprinkle some brown sugar on it and eat it while working the milking machines. Yep, that stuff is unhealthy!   tickedoff

Way back in the old days,when I was a child, we sold our  raw milk to neighbors, or traded for farm eggs and such.   Butchered and processed our own hogs and cattle too, and I've got half a cow raised by my brother in law in my freezer.  I ain't dead yet.   cooldude hoser

It's not just the FDA but the dairy industry in total that seeks to maintain control. I buy my dairy in Missouri from an Amish Mennonite farm. Mostly goat, some cow but also eggs and chickens. All organic, cage free, no antibiotics, no animal byproducts and humanely raised. In Missouri they can't come to me but I can legally go to them or arrange to meet them somewhere. It's a hassle, more expensive but very much worth it. I'm a strong proponent of buying locally to support local food suppliers. Try watching Food, Inc.

I grew up on a dairy farm and until I was about 18 I had never drank store bought milk except at school or while visiting someone else on a trip etc.  I thought store bought tasted watered down.  All of our cooking at home was done with it and we drank alot of it.  There are untold thousands of gallons of raw milk that I have drank. 

We also made butter at times when a milk truck couldnt get to us in the winter and we were forced to dump some milk down the drain.  Sometimes we would save a few hundred gallons in one cooler and dump the other tank.  Then make butter and give it to family and friends.  Thats what we used during the rest of the year. 

Some of you may remember me ranting a couple of months back when the EPA announced they wanted to treat milk as a haz mat material due to the butter fat.  Farmers would have to construct spill control dikes and have approved storage and spill control plans... just as if it were fuel or oil being stored.  MSDS sheets for milk... oh yea.

What happened to the other half? Is it OK?
I had real milk one time. Grandpa's farm in Missouri. I went to "help" him milk the cows (3) and laughed as he shot a stream at the cats. Even moreso as he shot me. We had a wonderful summer and myself nor the cats ever missed a milking. What I'd give for a shot-o-milk.
