Sounds like the charges were puffed up to bolster the arrest and jail stay.  They'll most likely be dropped before trial.

if he hit the cop with the weedwacker he should be charged

I predict disordlerly conduct  a violation is how it will end up

and sears lost a customer  they should have vouchered the weedwacker and had him return
