This evening, I got home from work, my wife was at the pool with the kids, she offered to pick me up bc the kids had a meet and were fine with friends from the pool.

On the way back a lawn crew was mowing the lawn at the local school. Well, the mower hit a rock and it shot out and hit my wife's car. The entire crew stopped when it happened and watched us. So we stop, there is a couple scratches in the paint down to metal from the rock. So all the worked do not speak english, so they go get theuir supervisor...well he comes over and start saying what is the problem, there are marks all over the door. Admittedly the car is not perfect. I told him, just give me a number and I would get estimates. So the guy start saying the door has other scrapes on it. Then he says, call the cops, I say it is not necessary. So he goes off and calls the cops, so the cops come and he starts in the them with I am mouthing off. So I blew up, I told the cop that he started with me and there was no way in hell I was backing down.

I gave the cop my info and said I would be in touch.

I was not looking for anything from the moron other than an apology...now I want his ass!!!

Am I wrong???

sounds good to me. go for it.

same thing happened to my wife's car.

lawn care company owner cam over gave her his info.

i made an appointment to have it replaced, the owner called the glass place, gave them a credit card #

made it as good as new. not one single problem. i was amazed.

Has nothing to do with the jerk, will be all insurance.  Get estimates, submit the claim, get your check and then fix it if you want. Don't stress out with the a-hole supervisor. Life is too short.

No matter what you do it will end up with the insurance companies involved determining who's paying.

Agree.  And calling the police is just to document statements and damage by an uninvolved third party.  There was no need to get upset over this.

Along the same vein, I had a parking lot incident recently. My car is fairly new and up until a recent trip to the grocery....not a scratch on it. The lot has angle parking in opposing lanes with no separation, you park nose to nose. I pulled in and noted a large red p/u next to me, I'm Jones'n for a p/u so I can get rid of our older second car and my trailer....but that's another story. I left space wide enough to open my door all the way plus some extra space. When I returned, just as I reached for the handle I noticed my driver's door and fender now had two lines of deep scratches. I then realized there was a different car facing mine and a grocery cart sitting between our vehicles. The scratches start in front of the wheel well, then continue after that opening for the rest of the fender and half the length of the front door. For reference, I wheeled the cart sitting there over between my car and the red p/u and there was more than a foot of space on either side. I have no idea what the person was thinking, but obviously wasn't paying attention. I then noted some scrapings on the side of the cart at the same level as my new scratches. I turned it in to the insurance and waited, I have $100 deductible for comprehensive and $250 ded. for collision. My call back from the adjuster told me the $250 ded. applied because it was collision and I exploded. What bugged me from the start was her extreme accent, I could hardly understand her but she insisted she was right. My estimate by the way....$971, because they can't just touch it up, they have to repaint the entire fender and door, plus possibly blend in the outer end of the bumper cover to match the fender. I got a check a couple days later minus the $250, so I called my agent. Our homeowner's policy includes the cars, plus we have a separate flood policy with them. All together, it's costing us close to $3500/yr. and I suggested to him if that's the way his company will treat us if a hurricane hits, then I don't need his services....it's up for renewal next month. Then I told him of the argument I used with the adjuster; assume a wind breaks a branch out of a tree and it hits my car....is that comprehensive or collision? Her answer; comprehensive. Then I asked; assume that same wind also blew a grocery cart into the side of my car and scratched it....is that comprehensive or collision? Her answer; it all depends!  HUH??

My agent passed that on to someone in their home office, who immediately took action. I received a second check for the $150 difference in deductible and she was made to call me and apologize. Frankly, I don't care where the money came from...his pocket or the insurance company. If I'm paying that much for insurance and something happens to the car when I'm nowhere near it, I have no intention of paying extra.

That was my first thought...since I know they mow there weekly, maybe I just do that...anyone got a number?

My wife called me this morning and asked that i let it go.... tickedoff

So INS might be the way to go...an anonymous tip.... coolsmiley

Your insurance will probably wind up paying for the repair.  Even if the lawn care company has insurance it will not cover something like this.  It is similar to when a semi truck throws a rock that damages your vehicle... it is not considered to be a party-at-fault type of accident.
