i know not Valk related. But need help.  Woman ran into back of me. Is her fault.  I got estimates at  her ins.  shop and requested new parts. Her ins. notified me and said no on new parts. Her ins. SF is wanting to put used parts on my car. Is a 99 pont. GP I bought new.  parts around 2k used 2800 new.  Any hope.?

While i'm NOT in the insurance business you are talking a 13 year old automobile. Parts be plentiful in the salvage yard for your ride. Maybe if you make up the $800.00 difference?? And B T W this just be a suggestion. My .02 and thats about what it's worth!! RIDE SAFE.

 Take it to your shop of choice. You should not have to use the one her insurance company chooses. ??? That's the law in Washington State. police Call your insurer to confirm your options where you live. Good luck! Smiley

You are the injured party.  She is at fault.  It's her responsibility (or that of her insurance company as her proxy) to repair your damage to the state it was before her action.

That said, technically the parts she bent were used parts.  It may not be reasonable for you to insist that 13 year old parts be replaced by new parts.  It is reasonable for you to insist that whatever they use it is to be as good in appearance and function as what you had before the accident.

If I were you I might insist on a repair shop of your choice rather than one of their choice.

Keep somewhere in the back of your mind that the way people (including you and me) deal with insurance companies has a direct impact on the cost of insurance.  We are each either part of the problem or not as we choose.

You have the legal right to insist on reasonable repair.

Used parts are fine...I see no reason to insist on new...we've had a couple serious repairs with used parts.

BUT...

Insist on OEM parts for body parts, used okay as long as they are OEM, and just make sure the shop has a lifetime warranty.

You are not required to use their body shop.

Take it where ya want, and used parts are fine so long as they are straight and not banged up.    If banged up then they get a lot of bondo in most repair shops.

Just my $.05 worth.

Wife, kids and myself, we have bent a few fenders and have always taken the vehicle to our choice of a repair shop.    The adjuster has a specific amount of $$$ to play with on your repair.    What ever he saves the Ins Company he is paid accordingly.

if by sf you mean state farm, my wifes car (06)was hit last year. state farm (other ins) fixed her car with used parts. repair was fine. 9 months later the exhaust developed a bad leak. state farm fixed it no charge. something  about hidden damages. cooldude

  We also had an accident to our 09, and it was borderline on new or used parts. We let our insurance company ( OUR) recommend a shop. We have an agent that works for us. If there is a problem with the repair, then it is back on the insurance company. They installed new parts as the difference was minimal. We had one minor issue that was handled faster than I ever thought possible.
  A Jeep made a lane change over the front fender of our car. We have State Farm for all of our vehicles. Two classics, a car. a truck and a Valk.

wasnt there a law passed a few years back that they had to use new parts due to the chop shops?
also yes let your ins co get involved because your premiums are going to go up because of this accident,, no matter who is at fault the record will show vehicle to vehicle accident...

I think doing this is going to depend upon the coverage you have on your car.

If you have no comprehensive and collision you can be sure your insurance company will have nothing to do with you regarding the accident and needed repairs.

It the is the case (no comp & collision) you are at the mercy of that woman's insurance company so I suggest to tread lightly.

The only other recourse available to you would be arbitration (if available in your state) and/or a lawyer.
