Michigan riders would like the option to choose freedom from mandatory helmet usage. But the insurance lobby is determined to not give us that option.

Introduced by Rep. Lund on 9/13/11. Motorcycle owners will be discriminated against with only the lowest PIP benifits, even if wearing a helmet. Motorcycle operators who bear no fault for causing an accident will see recovery for injuries and pain suffering slashed by a minimum of 35%. Any operator or passenger who does not wear a helmet would be competely disqualified from receiving any kind of no fault benifits. Deprived from being able to pursue any economic loss damage against an at fault driver who caused the accident. Would also be barred from even collecting excess wage loss from, for example a drunk driver who parayzes him for life as would happen under this bill. This bill was stopped!

Legeslators make their living making laws.

Most licenced riders are also resistered voters. I am a precinct delegate and I'm quite involved in local and state politics.

As an ABATE officer I will support and work for those that allow us to keep our rights. We will also work to get idiot legeslators out of office. There is power in numbers.

Eventhough MI is a no-fault state for motorists,....motorcyclists are not included.

We have a lot of work to do and we could use more involved bikers. If you are currently unemployed in MI and you are a biker,...we need you to help for positive change.

Which was my point. They're anything but out of touch if they listened to their constituents. If you go accusing them of being out of touch when they actually do the right thing then what incentive do they have not to do whatever the hell they want?

The legeslators in the House and Senate have ruled by decree of the Governor that we must have a mandatory helmet law, under the direction by the MI State Police that they compile a list of approved helmets.

The MSP never compiled a list, let alone updated the supposed list. The MSP would/could be held liable in the event of a fatal crash while the person was wearing an "approved" helmet.

So the MSP sidesteps their compliation by saying if the helmet has a DOT sticker then it is safe to use.

However the DOT has stated that they do not "approve" or "certify" helmets. The DOT standard is an engineering standard that has many sections and subsections that are not mandatory or compulsitory in the manufacturing of motorcycle helmets.

Why is it that the states surrounding MI do not have compusitory helmet usage, and the insurance rates in those states is considerably lower than here in MI?

This.

We are in a mode where they throw crap, and we have to jump in front of it (if we hear about it in time) to catch it.

In touch...they would research and understand their constituents needs before introducing this stuff.

I'd agree that someone is out of touch, but "they" is a pretty general term.

If they're out of touch then you put them in touch, which is pretty much what happened here.

This kind of crap can happen in all 50 states. This is the type of supposed legeslation should be a "call to arms". Find out more about what is happening in your own state by checking out the AMA website, the ABATE website in your state, or better yet, browse the MRF website.

I'm not trying to make anyone jealous. I carry insurance and lots of it. Frankly, I don't like that it's not mandatory because a lot of people don't have it and my insurance ends up paying if they don't.

But I was making the point that you have options, particularly with motorcycles because there are companies that specifically cater to us (like Progressive) and others that do not.

Obviously you are not the stupid part because you said you do have insurance.


I should probably clarify; technically yes, you are supposed to carry auto insurance. But not having it will not get you towed from an otherwise routine stop (you will not be asked for proof of insurance) or get your registration automatically suspended if you don't have it (like it will in say, Massachusetts). You can also register your vehicle without it.

Basically the state puts the onus on the operator/owner to obtain it. Which in one sense I like (the lack of hand-holding parentality) but on the other hand I know there are a lot of stupid people who take their chances with my money.
