Police are investigating the death of a 61-year-old motorcycle operator who was involved in a collision with a Pontiac on Saturday.

Donald Dale Church of Grand Prairie was riding a 2000 Yamaha east on Main Street when a westbound 1998 Pontiac Grand Prix turned left on 23rd Street in front of him, according to a news release from police.

The motorcycle collided with the right side of the Pontiac. Church, who was wearing a helmet, died at the scene, police said.

The driver and lone occupant of the Pontiac was not injured, but was unlicensed and was arrested. He has been identified as Evaristo Hernandez, 35, of Grand Prairie and was booked into the Grand Prairie jail on charges of driving without a license or insurance. Investigators will consult with the Dallas County district attorney's office to determine if additional charges are warranted.

At the time of the wreck it is believed that the setting sun was in Hernandez's eyes and he did not see the approaching motorcycle, the release said.

The collision, the third traffic fatality in Grand prairie this year, is under investigation."

I'm tired of reading about not being seen on a motorcycle in broad daylight (with lights).

Tie him to a 4 X 4 pole mounted in the middle of the road for 12 hours of daylight and see if the other drivers see him (without lights).

If you cause the death of someone while operating a motor vehicle illegally, it should be murder, plain and simple.

Murder generally requires a specific intent to kill (be proved by the State). 

Vehicular manslaughter/negligent homicide only requires negligence or gross negligence, and can still get you some decent time in jail.  The problem is, not enough of these cases even result in a negligent homicide charge.

Ya know, when I was younger, one of the few things that kept me in line was the fear of punishment under the law if caught.  WHAT THE HELL WAS I WORRIED ABOUT???  Based on what I've seen lately, I could have done much worse and not suffered any consequences.  No License?  No Insurance? AND causing the death of another person while illegally operating a motor vehicle?  It doesn't make sense.
