It appears that the two flag poles are the same height.  That being the case, the US flag should be on the right pole.

If it is the flag heights. Texas by federal law is the only state allowed to fly it's flag at the same height as the American flag. Treaty provision when the sovereign nation of Texas joined the US.

Chauffer is correct, the flags should be switched.

It is a common urban legend that the Texas flag is the only state flag that is allowed to fly at the same height as the U.S. flag. The picture shows the US Flag on its own right, viewer's left.  This determination can get tricky, and I won't try  to give my own explanation, but I view this as correct.

From the place the pic was taken and for the 60 years prior to the day before the pic was taken, the light standard to the right of the Texas flag, and perhaps the flag, too, would have been obscured by the late, great, Big Tex.
