OK so now what are they going to do?

http://www.chicagotribune.com/suburbs/deerfield/news/ct-dfr-deerfield-assault-weapon-ban-tl-0412-story.html

Owners of assault weapons living in north suburban Deerfield have until June 13 to remove the firearms from within village limits or face daily fines after a ban was approved Monday night.

The Village Board of Trustees unanimously approved a ban on certain types of assault weapons and high-capacity magazines, amending a 2013 ordinance that regulated the storage of those items.

The new ordinance prohibits the possession, sale and manufacturing of certain types of assault weapons and large capacity magazines within the village, according to the ordinance. One change from the law as it was originally discussed exempts retired police officers from the ban, according to Village Manager Kent Street.

Violations carry a fine of between $250 and $1,000 per day, according to Matthew Rose, the village attorney. He said the fine is levied each day until there is compliance.

In an effort to not get my post pulled, or this thread locked, I will refrain from saying what needs to be done.
But, I do think a line has been crossed with this "ordinance".

this is always such a very stupid and disgusting thing. why do they think any police officer retired or not is above and immuned to basic human emotions? there are many cases of any police officers going off the deep end.

The area this takes place in NOT the least bit surprising to me at all. In another life I worked a time or three in Deerfield and dispatched from there. My question-finally-don't this bull kaka fly right in the face of the 2nd Amendment? Something in the 2nd Amendment stating-Shall NOT be infringed? Yeah-kinda thought so myself. RIDE SAFE. As an aside and a P S-Know NOW I made the right move 40 years ago.  cooldude

Yup.....and any "oath taker" who follows through with this isn't abiding by their oath IMHO. How can these liberal politicians pull stunts like this and get away with it, and who in their right mind would EVER turn in their guns or illegal mags?  uglystupid2

I'm thinking this will be tested in court.  To the supremes if necessary.  Don't see it standing.  Has no bearing on me personally.  I have been boycotting IL for nearly a decade now.  I hated that I pretty much had to drive across it for Morganville Inzane.  And likely again this year.  However I have enough range now I can not spend any money.

Seeing as it's IL/Shitcago, aren't all ARs (and other firearms) already registered, licensed, FOID carded?

And BTW, there is already federal case law for the proposition that possessors of illegal things cannot be required by law to self identify (for taxation or other reasons), because it violates compulsory self incrimination IAW 5th Amendment.

NRA/GOA/etc files for Federal court temporary restraining order (TRO) until full hearing on the legality of said ordinance IAW 2d Amend, US Constitution.

In the meantime (with no TRO), a fine is levied.  No payment is made.  The state seeks to enforce the fine.  The G bears the burden of proving the firearm is unlawfully possessed inside the village.  How do they do that?  The guy charged remains silent and cannot be compelled to testify.  They going to kick doors?  An AR on a preexisting G list to a known address would be PC for a warrant to kick doors.  If he notifies them his AR has been moved out of the village (IAW the ordinance), they have no more PC for a warrant.

Instead, how about making it unlawful to use firearms in a criminal manner?   Wait..... I think they probably already did that.

Not that it's relevant to the (illegal) banning of ARs, but one wonders how much AR crime Shitcago has?

I don't recall reading anything like that, and you know our media would have a field-day frenzy orgasmatron reporting it, if it was a regular (or even occasional) occurrence.

(Glock 9's would seem the more likely weapon).

Speaking of gun-safe zones I noticed a favorite restaurant, at which we have been patrons for 22 years, even before the current owners bought it, and are good friends with the owners, have a sign that is secreted pretty much in a discrete and hard-to-notice place, that thanks to local town ordinance and their wine license, they are now a gun-safe zone by order of the town board.  I always carry concealed locally.  They might be shocked to know they have never seen me when I wasn't armed.  At least they are discrete about it.  Pretty sure they are against the rule and so hide the sign.

A Federal Appeals Court has already concluded that assault weapons are not protected by the Second Amendment. New story at the link:

https://www.nbcnews.com/news/us-news/assault-weapons-not-protected-second-amendment-federal-appeals-court-rules-n724106

And don't necessarily count on the Supreme Court to come to the rescue. They haven't taken up a Second Amendment case in almost a decade.

https://www.washingtontimes.com/news/2017/nov/27/scotus-upholds-ban-assault-weapons-open-carry/

You may also recall hat there was a National assault weapons ban put in place under the Clinton Administration, which the Supreme Court deemed was constitutional. The ban expired during the G.W. Bush Administration under a Republican Congress that voted against renewal.

I don't think the leaders in Deerfield are pissing up a rope. This is real and very likely to survive legal challenge.

In a 10-4 ruling, the 4th U.S. Circuit Court of Appeals in Richmond, Virginia, said the guns banned under Maryland's law aren't protected by the Second Amendment.

Well, pure and simple, the 4th Circuit majority got it (dead) wrong, and used the wrong standard of review (of a fundamentally guarantied right under the Constitution, which BTW is the only way they could reach the decision they did).  This is what comes from presidents and congress sending bleeding hearts (and minds) to the bench (for life).  It's a progressive malignant virus of our judicial system.

And SCOTUS decisions against accepting appeals from lower courts can never be taken as any form of quiet agreement with that lower court's decision.  Pro 2d Amendment justices can very wisely vote against taking up cases that don't present the optimal facts for landmark decisions, and/or where it is believed that it is not a good time to take them up.  Decisions to not accept appeals by SCOTUS review are not precedential in value, and carry no decisional value at all.

Judging from your map it looks like you need to get out and explore more to the South and West of ya, and I’ve ridden all the states you have listed twice.  cooldude It is for sure pretty up there, I just don’t approve nor will I support Draconian legislation.

I agree. I'd love to get down the Blue Ridge Parkway and ride around the Great Smoky Mountains. Just haven't been able to do it yet. Lots of family duties with elderly parents take up time. Some day.

In 2001 I did go to the first InZane in Zanesville, OH. I really enjoyed riding around that area of OH. Beautiful country and very nice people. I went to the Honda Homecoming in Marysville and toured the motorcycle factory. Really cool.  cooldude

Yes sir OHIO overall has some great riding, in particular East/NE/SE/South/SW.......but North and NW is the flatlands towards that "really big lake".  Grin If you ever make it down this way be sure to let me know, would be glad to show you some great roads. We also have the largest Amish and Mennonite population in the country, Charm/Millersburg/Berlin.......   http://www.ohiosamishcountry.com/

If you can ever ride the BRP you need to do it, I've done it from start to finish 3 times, and once you get down to the Smoky mountains, the roads and scenery only gets better.

They are being sued under state law that says cities cannot have more restrictive e laws than the state.
Not under second amendment.
