Having sex with a traffic offender may not have been a crime (before), but it probably wouldn't get you a performance award either (a clear violation of employment rules gets you fired).

So now, you get fired, and prosecuted (maybe). (and just for grins, maybe an STD or the crabs, and a divorce and lose 1/2 to 2/3s of your stuff, and child support, and alimony).  

And BTW, in case you haven't heard this, a few states are now letting spouses sue spouses for giving them (often incurable) STDs (like herpes).  With big money damages well over and above what that spouse would get in a divorce (which is usually pending in another court).  And guess what?  It doesn't matter if you know you had the STD or had even developed any symptoms yet.  If you got it yesterday, and passed it to your spouse tomorrow, the only issue is, how high are the damages.

While sex with detainees may not have been a crime, the discussion in the linked article about the detective who coerced women into sex under threat of criminal arrest or charges was already a large felony called ..... extortion.
