How about that SCOTUS ruling on civil asset forfeiture?  It's not often the court agrees 9-0 on anything.  There have been some horrible abuses of these laws, like people losing their home because a grandson living in the basement sold some pot.

It's about time! A county or two here in Florida was infamous for misuse of the law. Mostly along the I-95 corridor.

Civil asset forfeiture is a very good thing.... for organized crime, corporate drug smuggling, RICO law stuff.

But for Harry Homeowner it has often been a "taking without due process of law."  IE theft.

I haven't read the SCOTUS decision, but what has to stop is taking from citizens with no due process proof or showing of the forfeited assets being an actual part of a criminal enterprise, BEFORE the taking.

Forcing someone to spend $10K over a period of years to get money (or property) back is Stalinist corruption of the worst kind.

My problem begins with the fact the seizure is immediate and not something that happens after a trial and conviction  not that the asset forfeiture is a slippery slope in itself

You know, even if they caught you packing in 300lbs of weed on donkeys down your way, they wouldn't probably forfeit your asses.

No self respecting border patrolman wants to be seen riding around on one of those.

I believe the decision on this was that the value of the forfeiture could not exceed the value of the fine.
The case revolved around a drug deal where the fine was to be $10k and the forfeiture was a $43,000 + Land Rover.

SCOTUS said you can't do that.

F6Dave: Snow levels down to 3,000' elevation. But the news just reported snow at 2,500' We're running 20deg below normal and more rain than normal this winter.
