CHICAGO (AP) Attorneys for "Empire" actor Jussie Smollett said Tuesday that charges alleging he lied to police about a racist and homophobic attack have been dropped.

Smollett attorneys Tina Glandian and Patricia Brown Holmes said in a statement that Smollett's record "has been wiped clean." Smollett was indicted on 16 felony counts related to making a false report that he was attacked by two men.

Among the questions that weren't immediately answered was whether prosecutors still believe Smollett concocted the attack and whether there's new evidence that altered their view of events. Typically, a minimum condition of dropping cases is some acceptance of responsibility. In a statement, the Cook County prosecutors' office offered no detailed explanation.

"After reviewing all of the facts and circumstances of the case, including Mr. Smollett's volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case," the statement from spokeswoman Tandra Simonton said.

Smollett had made a $10,000 bond payment to get out of jail after his arrest on the charges.

Police and prosecutors have said Smollett falsely reported to authorities that he was attacked around 2 a.m. on Jan. 29 in downtown Chicago because he was unhappy with his pay on "Empire" and to promote his career.

Smollett, who is black and gay, plays the gay character Jamal Lyon on the hit Fox TV show that follows a black family as they navigate the ups and downs of the recording industry.

Smollett reported that he had been attacked on his way home from a sandwich shop. Smollett said two masked men shouted racial and anti-gay slurs, poured bleach on him, beat him and looped a rope around his neck. He claimed they shouted, "This is MAGA country" a reference to President Donald Trump's "Make America Great Again" campaign slogan. He asserted that he could see one of the men was white because he could see the skin around his eyes.

Police said Smollett hired two men, both of whom are black, to attack him. Police said Smollett paid the men $3,500.

The men are brothers Abimbola "Abel" and Olabinjo "Ola" Osundairo, and one of them had worked on "Empire." An attorney for them has said the brothers agreed to help Smollett because of their friendship with him and the sense that he was helping their careers.

Police have also said that before the attack, Smollett sent a letter that threatened him to the Chicago studio where "Empire" is shot. The FBI, which is investigating that letter, has declined to comment on the investigation.

I think you have got the idea here. There is the Federal charges that probably carry more weight and jail time than the state ones and Illinois just cleared the table for the Federal charges.

Seems to me from the State's perspective this was just a false police report. Didn't get much beyond that. Yeah, he milked it for all it was worth but does the State of Illinois want to waste time and money prosecuting this guy or just feed him to the Feds and let the Feds do the work?

He pays the State off with $10K and gets to skate on State charges.  Now he may have more money than most (I dunno), but who would give up $10K that was innocent?  The 10K payoff agreement should have a waiver of (wrongful arrest) civil suit in the boilerplate language (and maybe a requirement not to talk about it either) (but he keeps proclaiming his innocence).  Chicago is foked up, but they probably have some lawyers that actually passed a bar exam sometime.

If the Feds are still looking at it......good.

Maybe the network he works for is looking for a federal pen gay reality show.

On Thursday, the U.S. Senate passed a bill that would make lynching a federal crime.

The bill, which was introduced in June by Sens. Kamala Harris (D-Calif.), Cory Booker (D-N.J.) and Tim Scott (R-S.C.), had previously passed in the Senate in December, but did not pass in the GOP-majority House before the end of the 115th Congress. The Hill reports that the bill passed Thursday with a voice vote.

I honestly haven't paid much attention to this story. But I don't remember him saying it was a white dude that attacked him. As I remember it, he said 2 dudes dressed like ninjas started yelling racist and gay slurs at him, then attacked him, and put a rope around his neck. There is SO MUCH that is just unbelievable about his story. I don't know what to make of it all.

I'm glad the Dimocrats are keeping up.  And keeping busy, pandering to their base.

One wonders if only black people can be lynched under this new law.  The rest of us will just have to fall back on murder statutes (which generally work).  Though if so, one might politely ask if that is in violation of the equal protection clause.

Of course the historical problem was you could not get state court convictions for white on black violence, in white jury/courtrooms, and there was no simple Federal murder statute (it was all state crime).  So KKK guys got 2 years under Federal law for violations of civil rights (not murder), for murder. Thus a Federal crime for lynching (I have no idea how it is different from hate crime though).  But those days are gone, aren't they?

IMHO, we don't need new laws to cover murder (however it's done).  If you want to make one murder worse than the other, simply change the sentencing laws (not the murder laws).
