If this is all it takes to get workers comp.,  I'm all for a little overnighter while working away from the office!  :2funny:

Well don't dismiss that Idea here in the United States.  There are actual rules concerning employees traveling for work that depending on the state cover the employee for every hour they are traveling.

It is call the "Coming and Going Rule" for worker's compensation (No punt intended).  Under this rule the employer is responsible for you the employee 24 hrs a day and if the activity is considered "Health and Comfort".

There was a ruling by the Washington State Supreme Court I believe 2008 that forced a company to pay for injuries to an individual who 1.) Jay walked across SEATAC BLVD 2.) was on his way back from buying a pack of cigs 3.) was not scheduled to work that day (Sunday) 4.) Hit by a car.

The court said because he was away from home it was the responsibility for the company to be responsible for his "health and comfort" so they were liable for his injuries under the above rule.

Do shoot the messanger please.  I deal in these cases weekly as a Safety Manager.  Just adding fuel to the fire.

Interesting, did not know that.  Never filed workers compensation claim, but I guess sex is 'health and comfort'???  :cooldude:

Another case in Tennessee where a worker was stabbed in bed in his hotel at night sleeping by the person he was sharing the room with.  Under the same rules all his medical was paid for. 

After hours and not working but see above.
