The first hospital would be re-paying me back EVERY cent of ALL services rendered, or talking to my lawyer. 

My lawyer would be given directions to get everything he/she can if the hospital decides to talk to him/her instead of me.

Oss, I'd like to agree with you and I hope you're right, but I don't think this case is nearly unique enough.

CPS in most states has no required accountability and almost unlimited power.  It is outrageous, but it has become simply the way things are.

While heart breaking this story is not unusual, its getting scary. If the dr says you are abusing your child we see what can happen if the school calls police about abuse they can arrest you and take your children without a hearing. If the child calls police and says they are abused you can be arrested and jailed. It can take months to mount a legal challenge  and if your in jail and your family is separated its pretty hard. It is becoming more and more common. Some officers will talk about it some will not its pretty hard on everyone and they come in the middle of the night some times. Even if you are acquitted or not charged you may still be monitored and scrutinized by child services or the courts.

The twenty dollar question is whether the doc/admin personnel from the first hospital where they left without formal/approved discharge righteously thought the baby was in immediate danger, or whether they were just pissed they did not get their way, or keep running up the medical bills.  If a treating doctor actually believed the baby was in imminent danger, he was duty bound (and insurance bound) to take action.  And they probably did not know the baby was immediately taken to a 2d hospital for a 2d opinion (the family should have immediately had hospital two contact hospital one).

My dad was weak from an episode/swing of long term prostate cancer and got a bad secondary infection while being tested in a dirty FL hospital on vacation. He was admitted and went downhill fast.  My sis-in-law 25yr-BSN/RN (with whom my parents lived in MI) spent a half hour asking admin and nurses questions over the phone, hung up, and got my brother to fly them both to FL where, after an argument about his treatment, they put him in a wheelchair and forcibly removed him from the hospital (against orders/irregular discharge) and flew him home to his own doctors with immediate improvement.  The family would not be stopped and said they'd fight, so hospital security stood aside.  No report to anyone was made.  It probably saved his life.

It will be interesting to follow this and see where it goes.  Unfortunately I think this will be swept under the carpet and kept low key.  Not sure when it happened, but I have not seen anything locally about it.

Not to steal the thread or change the topic, but with Government being so intimately involved with Health Care now (ObamaCare), I predict that this is how they will work to control the people and take their guns and money.  

I didn't notice any one meeting and greeting the officers when they entered... doesn't seem like a lawful entry to me.

The parents and lawyer were on tv yesterday.  They have the baby back, but child services is still visiting them every couple days, and they are still listed as high risk parents!  WOW.

In most states, they HAVE to respond to any report.  If your neighbor and you have a disagreement, he can call you in!  They MUST at least come out.  And, as long as he can make up any reasonable excuse, he is safe.  Say your kids were playing hard, and screaming as they ran around, he can say he thought you might be beating them, and he is ok.

If child services tells the police a child is in the residence and is in danger one of two things happens.  If your door is unlocked, the police come in.  If your door is locked, it can be kicked in for the police to enter. The police are acting under good faith. Right or wrong the police are just there for the child. The parents don't matter: the child's safety is all that is important.

There is one truth in every state Gov. DCS is a messed up system. I have helped take children out of a house that is nicer than my own one day and can't get them to come out when I have a child living in filth and need their help the next. The only time the police can take a child is if the child is in immediate danger of death or serious bodily injury.  DCS can take your child for any report of abuse they think is justified. The police have to prove the parents are unfit and then take the child. DCS takes the child and then the parents have to prove they are fit.

I am a father and a cop, as a father I would be real lucky to only have bruises if anyone tried to take one of my children. As a cop I will do whatever it takes to protect every child.

   First, the situation stinks! What Willow and Jess said are exactly true. Start at the beginning: ie- the hospital: The attending physician registers a complaint with CPS (and or possibly LE), they in turn react and must investigate, one or both agencies. IF law enforcement hasn't been contacted and CPS has,  then they are contacted by CPS about a "possible" child abuse case. IF only LE has been contacted, and CPS hasn't been, then CPS is put in the loop. Whom ever said CPS is a messed up organization is right, they pretty much suck but in this case they lead the way followed by law enforcement. If CPS has "probable cause to believe" thru investigation that there is neglect, they may remove the child from the threat, but the way this is done is wrong in this instance.
This case is one sided, and IMHO there  hasn't been much followup / investigation done which is the fault of CPS and LE combined. Had the job / investigation been done properly by both agencies this would have never have happened. This is a law suit in the works and rightfully so. I don't like to ever mention this but I spent 28 years as a Sgt in LE and if one of my guys would have done this in this mannor he would have been looking for a job!

I have some sympathy with the LEO's understanding they are simply required to do what they're required to do without applying a question of right or wrong.  This despite an open confession that they would not abide being done to them what they are required to do to other parents.

Seems to me I can hear that great philosopher, Cool Hand, uttering, "Saying it's your job don't make it right, Boss."   :)

I wouldnt pee on a CPS puke if it was on fire. They are scum that justify their existance and verify their own importance through lies and force. Never again.
However beautiful the strategy, you should occasionally look at the results.

Just a little spleen venting here. I'm not going to change anybody's mind and likely won't say anything you haven't heard before, but I just need to get some of it out.
First of all, shut CPS down. Period. I'm sure you can find some cases where they's done some good, but no amount of success can justify the existence of an agency responsible for the actions depicted in the above video. Shut it down. (Might want to take a look a Game and Fish in most States too.) There is way too much power with way to little accountability. All too often, draconian actions appear to be predicated on a bureaucrat's bruised ego. Just close it down. Then we can address problems from a fresh start.

Since the guy I voted for in 2012 won the White House, I've turned my political support and affiliations almost 180°. I've sent more letters, emails, faxes and phone calls to Representatives and Senators (both U.S. and State) in the last six months than I have in all of my life up to that point. I've joined the NRA, and try to squeeze a few dollars here and there to support pro Second Amendment causes. (And that's no easy feat as my wife is retiring at the end of May.)
Yet my core values haven't changed. Only my perception of who presents the greater danger to them. I've never been a cool-aid drinking, glass eyed supporter of the President. But during his first term, while making no secret of his leftist leanings, he didn't actively push a gun grabbing, socialist agenda. At best he gave luke warm lip service to most of the left's sacred cow legislation, prompting a lot of criticism from them. There were those who warned that he would go simian fecal psychotic in his second term. Tragically, I wasn't convinced. I am now.
Is it too late? Is there any hope?
As I've said umpteen dozen times in the last few months, the President won the last election by a slim margin in the middle. (62,611,250 to 59,134,475 popular votes.) I am not alone in the sudden, painful discovery of the knife in the middle of my back. There is some number of voters, possibly small but also possibly crucial, that will no longer vote for the President or his party. I would even work against Democrats like Mark Pryor, who isn't especially detestable, simply in the hopes of taking the Senate away from the Democrats. At the very least, I hope they lose some seats and are given a moment of pause.
Yes, I will have issues with Republicans down the road on other policies. But for the moment, in this battle, I find my cause more aligned with them. I won't change my core values to fit a party. I can only select the name on the ballot that I think/hope will be most aligned with my goals.
From my position, the President has done incalculable damage to the Democratic party. Damage that I seriously doubt can be undone before the 2016 general election. The question is, how many voters feel the same as I do? It doesn't have to be a large number, just a crucial number.
