Uninsured motorist is not the same as Hit and Run. Everybody read !!!!!

Its been a up and down ride for me since my accident. Last week my Insurance Co ( Dairyland ) informed me that they were not going to pay my medical because i only had UNINSURED coverage.   Apparently if you are involved in a hit and run as I was you cannot prove the driver was uninsured since you don't know who it was , so the Insurance Co says sorry. You actually need additional coverage covering Hit and Run. Apparently some states have laws covering this situation backing the Insurance Co. I was in total disbelief at what they were telling me. I paid premiums for 13 yrs thinking i was totally covered and now they are throwing this loop hole at me. I was numb.

Friday my insurance agent called me and told me that Dairyland had changed their stance and now are going to pay my medical. She said in all of her years this was the first exception she has seen. I don't know why nor am i going to ask. My bills have passed $ 20,000 and are still coming in. It was close to $ 5000 a day just for the hospitol.

So what i'm saying guys is check your policy because i'm willing to bet that almost all of you are in the same boat !

I'm glad they got off their lazy asses and done right by you.  :cooldude: In this day and age I've heard TOO cursed many stories about folks that have been with Insurance company for years and years and the first time they need to collect on what they have been paying for---  :crazy2: RIDE SAFE.

Went through that when the wife's car got rear-ended. No injuries just auto body damage but same story.

You don't have a driver then you can't prove they are not insured??? WTF!!
Cost me $500 to fix $750 in damage. It's normally safe to assume that if they ran off they had a reason to hide their information from the INSURANCE Co. And the PoPo! Thus no insurance should equal UNinsured at least in my mind.

Glad they are working for you rather than against you now.

I tend to agree.  But think about this, if anytime someone runs off the road and crashes all they have to say is that a car ran me off the road therefore it goes against the uninsured policy and not my collision policy (if you have one).  Now I'm not saying that's what happened here. That would send the insurance companies into a fury.....

If no contact is made, it is described as a "Miss and Run" and not a "Hit and Run."  A whole new set of rules apply to a "Miss and Run" and it is usually not covered by uninsured/underinsured coverage.

Sent my agent an email about this and got this. It comes from my cycle policy as it relates to the bodily injury part of the coverage.
Nationwide/Allied is ins. co.

3) Uninsured motor vehicle

yada yada yada ........ (that's me)

f) a "hit-and-run" motor vehicle which causes bodily injury to an insured. Bodily injury must be

caused by physical contact of the "hit-and-run" motor vehicle with the insured or with a

recreational vehicle the insured is occupying.

If there is no physical contact with the "hit-and-run" motor vehicle, the facts of the accident must

be confirmed by independent corroborative evidence of the accident from a source other than the

insured making the claim.

The operator and the owner of the "hit-and-run" motor vehicle must be unknown. The insured

must report the accident to the police or proper governmental authority within 24 hours or as soon

as practical. We must have a sworn statement within 30 days. It must state that the insured has a

legal action due to the accident. It must include facts to support the action. We may inspect any

recreational vehicle the insured was occupying at the time of the accident.
