Story. About the tasering of a friend

Don't know why I'm telling this, but, I'll try and keep it as short as possible. A friend [self-employed mason] daughter was beat to crap by her boyfriend. The Sheriff Dept broke down his door and ordered my friend to the ground. He of course being stubborn as I think he should have been, refused. He was very vocal about what was happening and loudly explaining that they should be trying to find the correct person rather that waste time with him. They hit him with taser. He refused to go down. Did again and again he refused to go down. Same thing again. And again. 4 times and he's still standing. So they take a club to his hip and shattered it. That took him down. His daughter then showed up and told the deputies what happened.
So, he eventually files suit. The Dept talks him out of suing stating they'll pay for his medical bills and loss of pay for a year. Of course, they renege. The Taser company sends a rep to talk with him and try to figure out how he took 4 and even survived let alone not go down. And, of course talked him into not suing. What I'd like to know is, does anyone know what their state law is regarding this. In NY only 2 hits are supposed to be allowed. I'm wondering if this is nation wide. Oh, this fella is now brain damaged,but, of course, he doesn't quite realize it. He was kinda nuts before this, but, he is worse now.

As far as the story.... don't know your friend, so no opinion there... but remember, there are two sides.

As far as the Taser, no there is no set of "nation-wide" rules for Taser usage; just local policies and procedures, at least in Ohio.

I have never seen anyone ride the lightning 4 times without effect. I also know the Taser company sure as heck isn't going to tell someone that 4 times should have killed him... it won't, or should I say, it shouldn't.

I'm not the type to sue people, but I'd sue them all and let the lawyers hash it out.... They entered his domicile and injured him. Any good lawyer would own the whole town for your friend. They over stepped their authority and should be taught a good lesson.

90 days to file a notice of claim in NYS  

dont remember the statute of limitations on 1983 cases  (civil rights)   pretty sure assaults are 1 yr

Sorry to say the victim should have gotten legal counsel ASAP

Would not touch a case like that at this late date or even give a consult

If stuff happens   preserve your evidence and file Notice of Claim immediately you can change your mind later but without the notice of claim he is probably SOOL

Please provide some details on the specifics of your evidence. I'd love to know the rest of the story and what part you played in it.

Not to call you a liar but your story sounds really fishy.  I've been tased before and it dropped me fast.  As long as you have a good connection you will drop.  Maybe if you wore thick clothes or had a bad spread you may not get dropped.   Four cycles or "rides" won't kill someone unless they are experencing excited delirium or have some serious medical conditions.  Even then, taser will deny their device caused death.

The taser will not make you brain dead, neither would a hit from a baton to the hip.  So again, not sure where you got your facts but maybe a little more detail is in order.

I too believe there are 3 sides to most stories.  I happen to believe this fella, he's always been a square shooter and truthful. And, he is a tough son-of-a gun.

I don't think I ever mentioned breaking his hip would cause brain damage. This guy has always been a bit, well, a lot, crazy. He's just crazier and way more forgetful.

I've been Tased too (qualification purposes) and it doesn't matter how strong or tough you are or what drugs you are on. The Taser short circuits and overloads everything. As long as there's a good connection your ass is a sack of potatoes. Also, by the time it's over you are completely exhausted. After my experience I just wanted to sleep.

When the cops show up they are brand new to the situation. They cannot show up and automatically start trusting people. That is how people get killed. Your friend should have complied and they'd have sorted it out. Getting belligerent with people who are called to offer aid in dangerous situations is unwise to say the least.

Did he not answer the door? Maybe they thought he was the boyfriend, that would explain why they entered the residence. If he's giving them grief thru a closed door they can and should perceive a threat.

If he continued after they made entry, he is still a threat. ALL he had to do is COMPLY. He SHOULD have understood they were there to PROTECT HIS DAUGHTER. It sounds like he was mad at the boyfriend and taking it out on everybody but the boyfriend.

I don't know how else to say this but to say it.... When I was tased I went down and there was no way in this world I could have controlled any type of movement much less stood. So basically your friend was not properly "hit" with the prongs or he is lying to you.

I have 330 days until I can retire from this profession. I hate bs stories like this and I could continue on why this does not make sense because none of it does but my rant is over. Next time your friends daughter gets beat up tell  her "Daddy" to handle it, afterall he's a tough guy.

I don't know how else to say this but to say it.......I'm 605, 300lbs, golden gloves, tournament karate,all sports growing up, special operations sniper, been rear ended on the freeway on my bike causing me to go thru the rear windshield of another car landing inside the car. Broke my left arm, left leg, pelvic bone cleanly, also internal injuries and I climbed out of the car and walked to the stretcher, not bragging but just explaining I know about pain. When I was tased I went down and there was no way in this world I could have controlled any type of movement much less stood. Police must access the situation properly (within reason) and not act on impulse. Complying is not what our Constitutional Forefathers would have done. LEO's must use reason or face the justice system just as any of us.

If the County agreed to a settlement of some kind, then later backed out, the applicable statute of limitations on filing suit should be tolled from the time of the settlement till the time the County reneged.

This is not about "authority" as it were. I never used the words "authority figure". This is about how to contribute to the process of putting a woman-beating scumbag in jail instead of interfering with it. If this incident ever even took place (and I have serious doubts) then it is the job of the responding officers to first assess the situation based on the info they have at hand. Acting like an evasive, belligerent ding-dong makes you appear as a suspicious party, not a victim. Don't call the police for help and then act like a total tool by being uncooperative. You deserve a good tasing forthat kind of stupidity.

In my adult life I have always been polite and courteous with the police I have interacted with, even when disagreeing with them. I have never had to be tased or clubbed or pepper sprayed or shot. Coincidence? I tend to think not.

Anywho... I got arrested once. At 11pm or midnight... way out on hiway 11 near Gowansville.
I was doing 45 in a 35. I had just changed insurance, and a paperwork mishap had caused
the DVM to think I dropped all my insurance so they revoked my DL. After the policemen saw
that I was an uninsured speeder with a revoked DL, they arrested me, dog-sniifed my car, towed
it, cuffed me, put me in the back seat and hauled me to jail. I didn't at that point understand why
my DL came up "revoked", but I knew it was a mistake. I didn't get mad, and was never impolite.
While at the station, with all my cards out on the table, the fact that I had just changed insurance
came up while talking to the officers. They put two-and-two together, didn't give me the speeding
ticket, drove me (in the front seat) to the place where my car was and saw me off into the night.

That is probably a situation where some people might get all angry and temper-tantrumy and tazed up bro.

I hope there's ways to deal with a bad cop later, but these guys were just doing their job. Cops get
shot by the kind of people who speed around at night with no DL or insurance... Cops need to
protect themselves...

The end of the story. I just happened to have coffee this morning with the ex under-sheriff of this county. We went to school together and see each other fairly often, never talked about this before, no need to. I mentioned this incident. He was still in that position at the time. He said it did happen. The dept was called by the daughter and the problem/beating was mentioned and she would meet the deputies at the fathers home. They arrived before she did. They tried to wake the father and get him to open the door. They broke down the door and entered the home and then woke the father. He was in the bedroom and refused to cooperate with the deputies and then tasered. He was tased 4 times and still refused to go down. His hip was then broken, but, stated the deputies deny beating him. The daughter arrived and explained the problem. The father was taken to the hospital and the boyfriend then found and arrested. Once the fathers hip was replaced and he was able to walk he then went after the boyfriend and was going to kill him. The daughter then intervened and the sheriff dept arrested the father and jailed him. Why do some women stick by these dirtbags. Apparently though she finally got tired of black eyes and left this clown and I guess he left the area. I'm confident as crazy as Eddie is he would still kill this guy. Oh, my friend retired by the time the settlement and lawsuit was going on.

I don't have a dime invested in this. Just relating a story. The man was awoken from a sound sleep in his skivies. Everyone I've talked to states he took 4 and kept standing and saying he wasn't laying down to be cuffed. The taser company came to talk to him about it, that says a lot. I'm getting kinda sorry I posted this.
