I got an email from my BIL and decided to check out the story.  Turns out it is true, the prep is dead, it happened back in Feb13 in Dallas, TX.  What I found interesting is the family thought the homeowner should have fired a warning shot or should have issued a warning.  No indication that they thought that what their little bundle of joy was doing was wrong.

IMHO, the elderly gentleman should be given an award for saving the taxpayers money, and preventing this predator from moving on and targeting some non-gunowner who may have been injured or killed by this lowlife.

I'm surprised how they refer to the castle doctrine as if it is a loophole that allows people to kill as if they otherwise would not be justified to do so.

Real simple-the first one in yer chest is the "warning" shot-the second shot is "fire for effect". And the 3d one is just to "make sure". RIDE SAFE.

The price of ammo (and common sense) prevents warning shots.

Thou in truth, there are probably some rare times it might be a good idea.

Last summer there was a story of a grandma getting cornered by 3-4 banger-youths.  She showed them a pistol but they didn't believe it was real.  When they advanced on her, she pumped one or two into the ground and brought it back up.  They ran, and that was probably better than granny trying to shoot the whole bunch of them.  Grannies get a whole lot more leeway in use of force than you or I will.

Given the objective facts apparent in any particular situation, you either have a right to use deadly force or you don't.  If you do, and can safely shoot, you may do so, and a warning shot is a waste of ammo you may need in the next 20 seconds.  But if you do not know if a potential perp is armed or dangerous or even targeting you, then use of deadly force may not be warranted, and if not, warning shots must also be avoided.  Investigators later on the scene are as likely to believe you shot at them and missed than fired a warning shot, ie you used deadly force when you had no right to do so, even thou you missed (on purpose or not).  

Two times a guy came right at me with every intention of assaulting me (as best I could tell).  Both were deterred when I showed them a pistol (not pointed at them, yet).  Neither showed any weapon other than their larger size than me, and a bad attitude.  A warning shot would have been poor judgement in both cases.

Finally, there are a number of cases where store owners have been convicted of killing perp/thieves inside their stores.  In each case, the store had been burglarized repeatedly, and the owner essentially staked out his own store, and lie in wait armed, and at the right moment executed them.  An otherwise lawful shooting was made unlawful.  It could go the same way in your home.  So if you do this, you have to plan ahead and make it look spontaneous, not planned.   And all shots must be in the front, not the back of the bad guys.

I'm not aware that you are required to give a warning shot.

I might shout a warning, if given time, otherwise two in the chest one in the head is all the warning that will be given.

I have never taken a life, I have never aimed a firearm at another human being. that doesn't mean I would be incapable of doing what I deemed necessary to save my life or others.

from what i've read, he wasn't able to be rehabilitated from the judicial system, so someone just done took a bite out of crime!!

No warning shot here. If I react like a reasonable man and in fear of great bodily harm or my life, I will protect myself.  If the Threat is going away, i won't.

That is the Plan. I'm not smart enough to know how I'll react in a real situation but practice helps.

you know, i've given it a lot of thought, shouldn't it just be common sense to know that breaking into someone elses house, to steal things that aren't yours, there's a good chance that you might get shot at?  seems logical to me......  didn't mama pipkins teach her kid anything? 

BTW, what's the nationality of the home owner?  i'm thinking the same as the dead theif, if it wasn't the media would have made a note of that.
