Yes, it is illegal for anyone to ride in or on a trailer, in most of the states.

I know we used to stop a lot of travel trailers in California and ask them to all get in the tow vehicle.

5th wheel is legal in Kansas, and you can pull a trailer behind the 5th wheel.  Used to do it to pull a fishing boat.  Never tried putting the boat in the water without removing the 5th wheel first, but I have seen it attempted.    Hoser
