saw this on FB thought I'd share. 110% the driver's fault, innattention, distraction who knows what excuse he'd have come up with.... he's lucky he not in jail heading for prison for felony vehicular  manslaughter or whatever charges they'd hit him with....

Where I live, passing a stopped and lights-flashing bus is 6 points, and a Huge fine.

I'd assume that his brakes quit on him, his only choice was to pass the bus.

2 thumbs up to the school bus driver for having trained his kids to look before approaching the bus.

I had a fish taco on bicycle, prat on a scooter and complete plonker in a car go past on the right.

Wish I could have punched them in the nose.

He wasn't looking to say the least.  Watch the vid and pay attention to the 2 cars passing on the left. Then watch her blind spot mirror out on the fender. The 2 cars are long gone before ANY movement is seen in the mirror.  He Had every chance to go past on the left (If he honestly couldn't stop).  There was no need to go out on the shoulder like that. Ass clowns like that give  professional drivers a bad image...

I'd have to disagree with you, if he lost his brakes he'd have a VERY immediate reason to slow down and try to stop. he just kept on truckin'.  didn't see any brake lights.

his only choice was to pass the bus because he couldn't stop in time, for what ever reason. I remember truck driving school they trained you to avoid the accident by going around it to the right.

he didn't lose his brakes modern trucks uses air pressure to unlock the brakes. If he lost all his air truck and trailer brakes would lock up. Driver is just unsafe. Been driving a truck 19 years this crap makes as all look bad.

What Ed said is right. The driver may try and claim the brakes failed, but, that argument won't go far. Lose air and the springs take over, brakes come on. [ Its magic].

I remember the 'good ole days' when trucks weren't plumbed the way they are today.  Trucks would pull into the diner across the road and leave the engines running especially during the winter [ it gets cold here, it did back then too]. As the engine idled air pressure would drop and the brakes would release. The truck would roll away down the hill, it was surprising where some would end up. I had to go and bring them back.

Back to the video, Its surprising a little kid didn't get hit.

well yes and no. no air means brakes lock up

you can get brake fade when your coming off a steep hill and over using your brakes. they lose their effectiveness. them suckers will start a fire!

it seemed the land was all flat around them parts, don't think he could claim brake issues.

My observation is why didn't the red and white cars traveling the opposite direction slow or stop? This makes me wonder if the lights (both signal and brake on the bus were activated at the time of pick up of the student. The truck was not far behind the bus in relation to the other car that passed the bus. Not defending the trucker just what popped into my mind when watching the video.

Orange lights until bus stops.
Then red ligths are activated once bus has stopped. On my bus reds were activated after air brake applied, neutral and then door opened.

Drivers will squeeze by until the very last split second on an orange.

I do not know what modernizations have been made to the signals for school busses but years ago the signals were manual operation. Flip out signs are now front and rear or just front on older buses. Newer buses also have led signs on the rear of the bus "STOP NOW IDIOT". That's what it should read instead of bus stopping or similar.

Signs are activated as the doors are opened.

Some drivers will crack door open as they are coming to a stop in an attempt to make the reds come on sooner.

Stupid, cause the kids will think it's OK to start crossing the street from the left or approaching the bus from the right.

Clearly the trucker screwed the pooch on this one.

Obviously he should have been aware of the school bus and given the bus and the student the respect they require.

He clearly failed.

But after that failure he was left with 3 really bad choices.

1. He could have tried to pass on the left.  I believe he would have struck one of the on coming cars before he could have cleared the bus.

2. He could have hit the bus.

3. He could have chose the option he did.

Clearly Miss Fate changed her mind and decided to let everyone live at that moment.

Truck driver is a f'in idiot. Deserves to have his licence taken away for a while.

As an ex school bus driver and seeing the remarkably selfish actions of other drivers I have little tolerance for endagering kids that ride the school bus.

Yes, anytime following a bus one needs to assume the bus is going to stop, especially during "normal" school pick up and drop off times. I have also seen busses rolling to a stop w the reds on sometimes for 50' on a busy road or if there are numerous cars approaching in either direction.

Should the trucker been more observant? Yes! Without a doubt, luckily no one was hurt. But again, it makes me wonder if all the lights on the bus working properly.

Yerp, I've seen buses stop without lights cause the driver had a brain fart.

However the bus was still in the traffic lane and the truck should have stopped lights or no lights.
