we got home last WK sat. Wife went to doc On Mon an they scanned her stomach, big black blue on stomach is going away but still having eating Prob. abit for now.    I'm insured with F'n Progressive insu co. Not my fault at all had my 2014 Outback totalled wants me to sign papers so they can pay bank off and wants to offer me 24,7 for what I paid 35 new. Also clames 6 of 7 replacement cars have eye sight & navigation which they didn't. they want to basic nock off approx 2, . well after about 3 dealers an 150 miles and playing on the internet a lot yesterday I found 1of 7 cars had it, I marked not having it, an 5 cars marked having it did not. I learned you can tell at a fast glance if the car has it and I found out it is actually listed in the ven #.    I was sent a report - Mitchell / some Att group which is not what the banks go by.  Just on the 2 items alone Progressive is trying to screw me out of the 2,approx.  So mon. After work I need to.contact the better buiss. & the Insu. commissioner. what do yous think?

If I remember correctly, the other vehicle was at fault?

If so, why are you even dealing with your insurance, for settlement?  It would be the other drivers insurance covering all the expenses.

Your insurance should have nothing to do with it. The other drivers imsurance should be dealing with you. Maybe we are understanding this wrong and the at fault party has progressive, if so it is their job to pay you the least amount possible. Get all your paperwork in order and prove everything. They wont have any choice but to pay everything in full. Don't take their first or even second offer. Decide what you want, payoff of vehicle, medical bills, lost wages ect. And stick with that number, could take a couple months to make it happen. I was rear ended by a drunk driver a few years ago and his insurance was great. Got my truck fixed and 10k on top of it. Asked me what I wanted and just told them to fix my truck and pay my 500 deductible and medical bills and 15k. They came back with everything but the 15k and offered me 10k. I took it and ran.

Ok, we got hit buy idiot that losses control of her veh then slamming a tree she hit us like s giant flyswatter. I needed help so I contacted my insu right away. They will take care of the car then they will go after the other insu. Co. But they don't want to give us sqwat for our car. And are deceiving us in the process.

Am thinking Progressive, your insurance, is NOT doing their job and going after their insurance company ASAP.  Don't settle plain and simple and tell Progressive to do their job and get the other insurance company involved.

NO idea what you had on the near new 2014 subaru outback, but at 35K must have been totally loaded.  I would think a 1 to 2 at most old vehicle would still be worth if you paid a fair 35K for it close to 28-29K still in my opinion, pushing 30K if lower miles on it say 10K miles or so.  27K or so seems a tad bit low, but doubt you will get over 30K for it totaled out, but shoot for that if I was you.  HOLD your ground firm until you reach a fair settlement.

Good luck,  paying for all that insurance premiums and then the ONE time you need it, they try to screw you over surely pisses us all off for sure.

Thats why I always get gap insurance on my vehicles. In this situtation my car would have been paid off.

Wife's 2004 Subaru Legacy was totaled in 2009.

Both insurance companies used what they called a CCC report to value the car.

This sounds to me like what you are describing.

I too found this report to be full of errors, even found one vehicle that the report said sold for $7500 that when I call the selling dealership I found out sold for $9500.

When I reported the errors our insurance agreed to pay the NADA value of the car.

This netted us about 3k $ more than what was originally offered.


Stick to your guns, call them on the erroneous report and insist on full NADA value for your car.

The longer you are willing to hold out the more likely they are to give it to you.

After a certain amount of time they have to clear the claim off of their books.

Her car was totaled in Nov 09, I argued with the insurance companies until Jan 10, but the additional $3,000 was worth it.

They count on people being desperate to get a new vehicle as soon as possible.

Still not totally understanding what or how this was written but the best advice seems to be .... do not settle.
Hell...from the sound of it your ins. co. is trying to low-ball you and settle as fast as possible.

Had a similar thing happen to me a while back, my advice for what it's worth.

1. Contact the other insurance company and tell them you need a rental car immediately. (If the accident is clearly their responsibility they won't balk on this.) After you have a car to drive you can slow things down and the pressure is lessened.

2. Do your homework. Go to the NADA and  KBB websites and value your vehicle at the retail level. That is what your going to have to pay to replace it. Also figure in sales tax, plate transfer fees and any other items damaged in the crash. Also look for vehicles for sale in your general area and see what they are going for. If it is more than the KBB and NADA figures document that information also.

3.  After you know what you should be getting for your vehicle, wait for their adjustor to come to you with an offer. The more anxious you appear to settle, the less you will be offered. Many get paid a bonus for getting people to settle for the least amount possible.

4. You contacted your insurance company and did what you were supposed to do. Now leave them out of it and work with the other company, you will get a better settlement with them. As others have said, time is your friend in these cases.

Not always.

When our insurance company finally agreed to give us NADA value for our car, I contacted the other insurance company and tried to get them to do the same.

They refused, I told them that they would just have to reimburse our insurance company for the car anyway.

Their response was, "Just because your insurance is stupid enough to pay that, doesn't mean that we are."

If we hadn't had full coverage insurance on our car we would've been screwed.
