You are driving your Lexus with your leg and talking on the phone with one hand and spraying hairspray on your daughter with the other ? BINGO you almost kill the poor old guy on his Valkyrie just trying to get home after a hard day at work ! She went from the right lane over to me in the left lane. Luckily I was able to hit the brakes and avoid a collision . But here's the freakin kicker. She looks back in her mirror AFTER doing it and keeps talking on the phone and fixing her daughters hair. Didn't bother her in the least. I think that's what pissed me off the most. It was like she felt no guilt about nearly hitting me. Sorry, I guess there's no real point here just wanted to vent.

Do you have LOUD horns? If not, get some and Use 'em. I have air horns, not as loud as quad horns but still effective. Have brought a few people's attention back to where it should of been.

I don't know about following her, but how about a clear, calm, convincing call to the local PD with a full description, make, model, color, plate, and I can absolutely pick her out of a lineup, and I will absolutely testify? (Yeah I know, a big PITA)
Even if there is no Cphone law or prohibition, this was clearly reckless driving and/or reckless endangerment (of her child too.... which is a nice twist from the usual self-interested caller).
If they say they're not interested, then ask if it's OK to use a lead pipe on the windshield next time (save this for the end of the conversation). Or go straight to the DA/PA office.
I've had my share of these incidents, but none lately. I now don't ride next to almost anyone (except stopped at lights). But I still see them on the phone/texting every time I throw a leg over.

Actually I don't yet on my Interstate. I put some on my Standard a few years back. But to be honest all I was thinking was hard on the front brake and get ready to evade if needed. I have made a number of alpha hotels sweat as I clearly sit behind them memorizing their plate number (or pulling out a pen and paper from tank bib at the light). I don't usually move my lips when reading, but sometimes I do.
Last time I went to the cops to make a report was 1970 or so. A pink Lincoln came across into my lane (on purpose, as she parroted my evasive maneuvers), and drove me off the road into the woods. Since it was certainly intentional, I was pressing for attempted murder.... so they threw me out of the station. I was 17 and not worth listening to.

Kinda sounds like what happened to me a few weeks ago. Only two on the road and she damn near hit me head on. Left the road on my side , hit a mail box then a tree. I had no more room I was right of the fog line as far as I could go without hitting the dirt then the ditch full of water. Until someone gets a handle on this it will happen time and time again. First offense: $500.00 fine loss of cell phone service for 3 months. Second offense: $1,500.00 fine and loss of driving rights for 6 months, cell phone use for a year. IF proven to be the cause of an injury accident: $5,000.00 fine and loss of driving rights for life, no cell phone use for life. Works great on paper until you try and figure out how to stop them from using someone else's phone or using a phone for them in a parents name. Guess your could pass judgement down to the Parent as well. OR, just have a device in every motor vehicle that blocks cell usage with the exception of a 9-1-1 call.

Had a few incidents like this and what is the most infuriating thing about them, the non caring. Apologies go along way to defusing a situation. Sorry it happened to you but at least you are ok.
Just so some know telling the Police is useless, unless they witness the incident its totally useless to say anything. I have had someone try to run me off the road told a cop and nothing. Consider it like the wild west when out on the road it may save your life. I find that very few are actually out to get you but the ones that just don't care or are dumber than a box of rocks or using their cell make up for the deliberate ones and need to be woken up.

Well glad you are ok for sure, I usually just go on and try to forget about it. I like country roads, there if someone takes me out and it was only them, me and a lot of trees well it was my time to go. Not trying to preach to the choir, but there are no safe road types. Sometimes traveling 70mph on an Interstate is much safer than a country road because of farmers, intersections obscured by corn, forest rats, etc. After two very bad collisions on 2 now totaled valks, I must say these situations don't phase me any more. I pretty much expect it and also try to pace myself with the traffic so that I'm nowhere near beside them or in a blind spot.

Lots of folk been trying to come up with ways to stop texting/phone use and driving. Pretty hard to come up with a real workable solution.
Thinking about it tonight and thought what if we were to legislate the means to shift the liability of such accidents to the phone manufactures or service providers. I'd bet in a couple of weeks we'd see some spectacular and functional ideas on this subject. The manufactures and service providers do know that their service is a menace when used while driving.

BINGO! If confronted with video evidence the police have to do something, if they refuse put it on youtube and make a big deal out of the fact that the police refused to act. I have had a few run ins lately with people that were being A holes, I have found that if I point my cell phone at them to take a pic or video, they tend to get out of Dodge quickly.

It was in town traffic , stoplight to stoplight . I was to her left about even with her bumper. I should have either jumped up or lagged back. I am usually pretty good about that, but I was tired and not being as aware as I should been. Although my cat-like reflexes saved me again, along with superb Valkyrie brakes.  For such a big bike these things can stop pretty damn quick.

What bothers me about this situation is the parent is passing on bad driving habits to the offspring. In Illinois , a new driver is ( if I remember) supposed to be driving with a licensed driver for a couple months. That way , bad habits are learned a lot faster. Illinois has a hands free phone law. If I was a LEO , I could write many tickets each day just in the 15 minutes I spend going to the bike shop. You can't fix stupid. I have called on many drivers that were erratic. Sometimes , they get caught.

I agree, but it isn't primary stop in a bunch of states. If found to be a "cause" of an accident then they can write the person for "distracted driving". There is a solution, a module in vehicles that stops all texting ability and only allows 9-1-1 use. Invent that and you will be a rich person. (probably already has been) I've stopped for texting and driving. A young girl setting next to me at a stop light 2 weeks ago was texting her buns off (17 yrs old) and looked right over at me. I was in a fully marked cruiser! I pulled her over and asked her what she was doing? She said "I wasn't driving"! REALLY, then what were you doing? Setting still. Whats wrong with these people?! These kids have it in their heads that they aren't driving if they are setting still? This isn't the first time I've heard this.

I've thought the same thing. If some drunken idiot jacka$$, that can't control his/her drinking, gets a ticket or in an accident after leaving the bar can sue the bartender why couldn't someone sue ATT or Sprint or Verizon if it was proven the culprit was talking/texting and not paying attention. This issue hits me hard today. As I was coming to work this morning, driving my Sentra, at one point on my route the road narrows from two lanes to one, and there is plenty of warning before this happens. The right lane ends and I'm prepared for this and in the left lane, (again there's plenty of warning to merge left). This butthead driving an 18wheeler from "JMF materials" was traveling right besides me in the right lane, and quickly running out of road, decides to move over into my lane!! Of the three choices I had; Play chicken with him (but me in a sentra probably not the best idea), or run over a few of the orange/white barrels on the left (it was a construction zone), or brake and let the d!cklicking-buttheaded-jackass by, I chose the latter!! But then that put me in a position to get the license #, and a bit later, as we were traveling down the same road, I was able to get by him and got the name of the trucking company off the side of the truck! I already got "JMF Materials" phone number, they're out of Pflugerville Tx, and attempted a call but they don't open till 8:30, but I will definitely be on the phone then to discuss this matter!!!
