In MI we have had the lowest M/C fatality rate (per 1000) ever in 2014-2015. Those statistics are form the MI State Police. But now an Ann Arbor safetycrat wants to change our "freedom of choice" helmet law. What a Crock-O-crap! Wouldn't it be better to prevent an accident than to mandate a secondary measure. http://www.prweb.com/releases/2015/10/prweb13011005.htm

I agree with you on the subject of choice and being accountable for your actions and results. I don't ride without a helmet, that is my choice and not a guarantee for survival in an accident. Why don't they put more focus on persons on cell and texting, and another trend I have been noticing lately is drive and passenger blacked out windows. You can't geuss-ta-mate vehicle driver intentions if you can't see the driver.

A democrat from Ann Arbor. Now theirs a surprise. We all know by now, these folks know better than anyone else. Just a question for ya Moms? What's your personal preference on wearing a helmet? Do you still have that bicycle helmet you used to wear? Do you ride helmet less, or do you prefer to protect what's left up there, as I do? Also, what does Pam suggest to riders in her safety training classes?

I hate to do an "I Told You So!" but..... this was what I posted back in 2012: In that case, I'll make a motorcycle related argument.
If you want a federal helmet law, please vote for Obama. You'll get it.
(Why? Once government has a vested interest in your health care (I.E. If Obamacare/Obamatax is allowed to stand) the government will have a LEGITIMATE interest in restricting risky behavior, since they'll be the one paying for it when you get hurt. And it won't stop with just requiring helmets. Any "risky" behavior will become more and more restricted if not eliminated.)

Come on Serk, you know they have been passing helmet laws since Obama was just a kid in that Kenyan village.

I agree with choice about helmets but has anyone read this? So its really not about safety but about monetary damages in lawyers terms?
copied from the article.
Michigan has a comparative negligence law, which means that if a jury agrees with a defense attorney blaming the injured motorcyclist for their injuries or the severity of them, the jury assigns a percentage of negligence to the case, and that percentage is subtracted from the dollar amount awarded to the injured biker. If a jury assigns more than 50% negligence, the biker gets no money damages for their injuries.

where did you ever get the idea it was about safety? Isn't all legislation about protecting one segment of society from another? Or from itself? As in, why should I pay higher insurance rates, to subsidize those who would rather not wear a helmet?

As in, why should I pay higher insurance rates, to subsidize those who would rather not wear a helmet? Let's expand that a little. How about " Why should I pay higher insurance rates, to subsidize those who would rather ride motorcycles?" We all know riders that have gone down, incurred serious injuries, in accidents that either would not have had injuries at all in a car, or much reduced. How many cars do you know that tip over in a little gravel in a corner, stay on the road, and the driver has serious injuries? Not many I bet.

Romeo said........"As in, why should I pay higher insurance rates, to subsidize those who would rather not wear a helmet?"
Have you ever done a bit of research on insurance actuarial tables? That is what the insurance industry uses to justify the excessive rates (and then some). And you must know by now that MI has the MCCA fee that is paid on every registered vehilce, and no other state has that fee. So if you think you are paying "to subsidize those who would rather not wear a helmet"; you may need to do some homework on your own.
Why do the states surrounding Michigan (OH, IND, ILL, & WI) have far lower insurance rates and also have either no helmet requirement or are "freedom of choice" states? Those states have had "freedom to choose" for years, and insurance rates have always been lower.
Here in MI one can choose to not wear a helmet if you meet the requirement criteria, or you can wear a helmet if you choose too.
You asked if I wear a helmet,......and the answer is yes. But I wear a helmet of my choosing and not a officially "approved helmet" of which there never been an official list of "approved helmets".
My wife is certified by the Motorcycle Safety Foundation as an instructor. The classes require everyone (students and instructors) to wear a helmet whenever they are on a M/C while on the range. The instructors are no longer required to wear helmets while riding to and from classes. The instructors do however teach that there are certain helmet requirements and when the student is legally able to choose for themselves whether to wear a helmet.
