Wednesday  afternoon girl losses control in the rain spinning into right guard rail and bouncing into left lane shoving me into the stinking cables which I rode until stopping while she still spinning bounces back in front of the 18 wheeler that was beside me and gets broadsided into the cables in front of me. Go out my window and get her out her back door and calm her until authorities the truck driver called arrives. NO INSURANCE and I have a $1000 deductible. On top of that it looks like they are gonna total my truck which won't be replaceable for what I get I'm sure. I always lose on these deals. Will find out Monday or Tuesday their decision. Just getting my rant off  Angry

I am glad you walked away without being hurt. (Some may call THAT a win.)  Wink

My daughter was hit by an uninsured motorist and even though her deductible was $500 she had to pay nothing, as it wasn't her fault. Hopefully your uninsured motorist policy takes care of your claim the same way.

No Insurance tickedoff that should be an automatic trip to the slammer until someone can come up with $$$ (not for bail) to pay for damages caused by said driver.

We have financial responsibility laws here in Missouri-BUT that DO NOT mean everyone has insurance-they have insurance when they go get inspected for tags and buy their tags-but they usually only have a one month rider!  :uglystupid2:You WILL get thru this. I know what everyone is saying and yes am thankful to be alive and uninjured. Just went thru totaling my other ranger in June and only had liability on it so had to eat the loss. Going thru this so soon afterward and not getting coverage by the at fault driver is annoying to say the least. That doesn't mean I am not thankful. Insurance co told me in KY it goes on my collision that I had on this truck and I am responsible for the deductible. I could go after the father of the girl but if he couldn't keep insurance on the vehicle he sure doesn't have anything to go after. Been down that road before and it ain't worth the trouble. I checked with the Company they said they had insurance with. They bought insurance in August and it cancelled on Nov 6 for non payment. That was for his truck. Her car was never on the policy. They won't answer my phone calls now. I was in touch checking up on her well being. Gave the info to the State Trooper who thanked me for doing his leg work. Says he will update the accident report and follow thru but agreed I won't get anything out of it. It happens ALL the time down here. People doing the right thing get messed over by those who break the law. They will probably have their license revoked but will continue to drive and harm someone else. I feel for the 18 wheeler driver who about puked in his truck thinking he killed her. Busted his front end up pretty good and lost all fluids. He wasn't making it home to Michigan that night.

Did they check her cell phone?  Her sobriety?  Did she have a brain? 

Getting your damages fixed is number one.  But seeing what punishment/consequences is meeted out to the dingbat is second (it fixes nothing, but feels good by way of justice).

That is what lawyers and lawsuits are for.  he can sue everyone else involved to try to recover his losses.

we have a $1000 deductible also.  even when you both have insurance sometimes the insurance companies throw up their hands and say they can't decide between he said/she said (which really screws you if your damage is below the deductible and the other insurance company wont pay up without going to court

we bought dash cams for both of our vehicles.

Good thing you were not on your Valk. Could have been worse. Thank God you were not hurt, truck can be replaced.

Yah,  you am sure are pissed as anyone would be, but once you calm down some you realize that everyone is fine and that is what matters.

Somewhat same thing, but not to that degree,  happened to me when my then new 16 year old girl teenage daughter took my 30K NEW truck to work and WAS NOT where she was suppose to be AFTER work of which I told her COME STRAIGHT HOME AFTER work.  A deer jumped onto the road, she swerved to avoid it, and took out a mailbox doing damage to the right side of the truck.  Worse thing was she 'technically' leaved the scene of the accident not informing the cops or homeowner of his trashed mailbox (was at night though in the country and all alone girl 16 years old) so I had to call the police that night to come to my home.

She got a GOOOOOOODDD talking to by the police officer and me as well.  Since then now almost 2 years ago,  she still has NOT driven my truck ONCE.  I made her pay for damages as well since she did NOT listen to me thinking she is invincible or something.

I'm a little confused though, I thought that the Uninsured/Underinsured insurance was supposed to cover this type of thing.

I carry the max that the insurance company will allow in this area for just such a scenario.

I carry the max that the insurance company will allow in this area for just such a scenario. 

Read carefully. My uninsured motorist is for medical only. They have multiple uninsured motorists policies types. Was an eye opener for me. Not been happy with insurance since moving to KY as they seem to have their own way of doing things........

You are absolutely correct. It's the "New American Way". Responsible, hard-working rule abiders like you (and me) are suckers and chumps. Paying the way for all of those who are irresponsible, unreliable, law-breakers who essentially get rewarded for their neglect by virtue of the fact they don't ever get penalized in any realizable fashion. And you (and I) are conservative a$$holes for even speaking out like there's something wrong with the way it's done in this country. Sorry for your losses brother, it's wrong. That's all there is to it. I especially like how they won't answer your calls now.  tickedoff

take your police accident report and go to small claims court on the damages.  You will win your claim and then they will get notice from the court they owe damages.  Then, if no pay still,  go to DMV (dept. of motor vehicle) with small claims judgment against them and if NO payment say within 60-90 days,  the DMV will take their drivers license away. 

I had to do that same thing for ONLY 1200 in damages guy rear ending my new truck.  NO job,  no car insurance,  no money,  nothing.   He did not want me to even call cops, but luckily I did since that police report was needed for sure.   After 10 months of non payment,  the DMV letter convinced him NO drivers license,  he would need that for sure.  I got sick of calling him up leaving messages weekly and after 10 months of him saying he will pay, he will pay, decided to take my own action and after that,  was handled quickly.  I got sick of his excuses and was too nice to him but a dirtbag is still a dirtbag.  He could have paid me 100 bucks per month for 12 months and I would have been happy.

So lets think of what if  state legislature should pass a law

If you drive with no insurance you have a choice in event of an accident which causes injuries or damage


What would be pro and con say you

Loss of the vehicle which is sold to pay the deductible of the other owner within 10 days if no proof of insurance can be produced

Loss of driver license (except drive to work )

Siezure of any and all assets to pay after trial judgment is entered

Its a game get the insurance card and cancel

Yeah right maybe the ins co should be forced to sue the uninsured
once their profits get sucked down their PAC will find a better solution
