Mark, (MaDsixgun) on the advice of his attorney, refused to pay for an accident at work, which was not his fault.

The general manager fired him yesterday for that reason.

BTW, Mark had his original thread on this topic purposely pulled by Carl because some here on this board didn't know the full story and thought Mark 'accident prone'.  NOT the case.

Mark's attorney will be continuing this case. There might even be a violation of OSHA regs which Mark's attorney is looking at, among other violations of Mark's Rights.

I doubt if Mark will post either here or on a new post but, as his Dad, I'm thoroughly pissed at this little p**** of a general manager.

No answers to this post are expected, I'm just bringing Mark's friends here up to speed.  Mark most certainly doesn't need this what with his medical diagnosis right now.

While I don't agree with the Gen. Manager's policy or action, I think this move should have been expected.   I sincerely hope Mark has already found another opportunity at another dealer or shop.   If not, I have no doubt he will soon.

Yeah, he fully expected it, along with his attorney.  He has medical insurance through his wife's employer so that also was taken into account.

As a 30 year master tech, no problem with finding work.

I remember the original post and agree with your opinion on the general manager.  Dumb policy - the good mechanics will be getting out as soon as they find a better place, too.  He may be opening the door by standing his ground. 

As others have said, any shop would be lucky to have Mark with them.  Good luck with his search.

Sorry, Wayne, I believe that his employer is required to have accidental damage insurance, and Mark shouldn't have to pay in lieu of same. Glad he has health insurance via his wife, it will all eventually work out, and hopefully a new job will be the better option.

It stinks when some idiot lucky to be in a position of power gets a kick out of flaunting said power. Sorry to hear about marks termination but sounds like this is going to be a blessing in disguise. Hoping a new and better job is on the near horizon for mark.

If pursued legally and in the local spotlight,  the firing may do more harm to the stealer than if they would have left your son employed there.   Although, am sure looking back,  your son after all of this doesn't want to work their any longer anyways. 

I had a chance, although never pursued, to get 2 separate car stealers in big trouble if I really wanted to as a customer.  One was when our Dodge minivan, next day AFTER the TSB for inspecting steering wheel shaft was inspected at Dodge dealer,  the steering wheel fell of TOTALLY while wife was driving (luckily no harm or accident happened).  The other was when taking delivery of a new chevy silverado,  dealer refused to give me the CUSTOMER $500 incentive rebate even after I gave them the official GM document stating it was customer money to keep, NOT optional.  Needless to say after buying a few new cars from them in the past,  that was the LAST time I stepped foot in that stealer well over 14 years ago telling them to shove their new pickup upon my NON delivery of it.  I could have told stealer to hold off one day while I get it straightened out with corporate Chevy informing them of the stealer refusing corporate rebate incentives NOT theirs to keep.

Like others here I've been to Mark and Twilas home. There is no doubt that Mark will come out of this with a better job at a GOOD dealership. I just hope the richard head that was his boss gits his cumuppance SOON.  cooldude RIDE SAFE.

Like others, I read the original post. Not knowing how things are in the US, I know here it is illegal to do what that manager was doing, and I'm glad Mark had the fortitude to follow it up, and not just leaving.

But in a nutshell the meeting I had with my manager a week ago he said that "we' have determined that "you" caused the damage and you have three choices,pay with a check. Let us take it out of your pay or a promissory note. Some choices huh. Anyway my lawyer stated last Monday that I am under no obligation to pay for damage from an accident and by "taking" money out of my check without my consent my manager broke the law. My lawyer also stated to tell them that any further inquiry on this matter should be brought up with my lawyer.

 Fast forward to last Wed I was called into his office again.  He said I had until end on the day on Friday to give him an answer. I told him I had one for him then. I told him my lawyer has advised me I don't have to pay. Before I could get the other part out he said well then we are terminating your employment here. Ok. I locked up my box changed and walked out. On the way home I called my lawyer and told him. I meet with him on Thursday to see what my options are at this point.  Wish me luck....

Get your stuff outta there as soon as possible.
Don't ask how I know, but it involved the owner of a 5 bay shop rolling a former employee's box out and closing the shop for a day. The owner was a great guy, and the former was a dick.
We still hung down the street so he could get his stuff with out missing any of it though.

When Mark recorded the conversation between the GM and himself, about the accident, the GM stated that "WE" determined that you (Mark)was at fault.
The GM consulted with no one.  He didn't ask the tech who saw it. Since the GM is 5 feet, two inches, I can only assume that he was using the royal "We".  I won't go into the little man syndrome.
