Clinton violated the Espionage Act

Hillary Clinton posted and shared the names of concealed U.S. intelligence officials on her unprotected email system.

Federal records reveal that Clinton swapped these highly classified names on an email account that was vulnerable to attack and was breached repeatedly by Russia-linked hacker attempts. These new revelations — reminiscent of the Valerie Plame scandal during George W. Bush's tenure — could give FBI investigators the evidence they need to make a case that Clinton violated the Espionage Act by mishandling national defense information through "gross negligence."

Numerous names cited in Clinton's emails have been redacted in State Department email releases with the classification code "B3 CIA PERS/ORG," a highly specialized classification that means the information, if released, would violate the Central Intelligence Act of 1949.

To violate the act just requires that you did it.  You did not have to do it intentionally, or with intent to be criminal.  Just doing it is the crime.

She did it.  She admits to setting up the server and email.  It is a fact that stuff was posted on the server BY HER.

Case closed.

But..........

Like all her, and Bill's, previous exploitations of the law, I think there is a less than 50% chance this Democratic White House will prosecute.

Any one else would already be behind bars for 20 to Life.

I think you're being very generous by saying the chances are less than 50%.   IMHO, chances of that happening with this administration and DOJ are slime slim and none.   (Oops, not sure how that slipped in there.  ;)  )Was advised that Slim left town.

I am pretty certain that, if, the FBI reccomends prosecution, and the Justice Department declines, that, somehow, that info WILL be leaked to the Press!  I also think that there is a decent chance that the FBI Director will tender his resignation if that happens.  I think any political shenagons will be at the WH and Justice Dept levels, not the FBI.

    I don't feel the FBI has the stones to indict,  I just don't have that kind of faith in them over this.   Like has been stated,..if they were going to bring charges it would have happened already.  Dont hold your breath waiting for justice, it just isn't going to come.  Not for H anyway, not here.  To me the worst part of H's  failures/ messes was allowing those four souls to die in Benghazi to save an election.  Absolutely criminal, and then the lying to the family's . We know this as fact from what the family's have said and the video evidence of that. We also know as fact about the e-mails she sent saying it was a terrorist attack to her daughter and others pre-dating the lies to the family's about it being over a video.  I agree with the statement already made saying "H's supporters just do not care about the facts or truths"   Benghazi , the reckless handling of classified e-mails/texts  (illegally) and the other illegal acts " .

I'm not a lawyer nor did I stay in a Holiday Inn last night. But I don't think the FBI has ever indicted someone. It works like your local police force. They investigate and give a recommendation to the prosecutors (who would be the Justice Dept. in this case).

I think if she's behind Trump in the polls Obama will "allow" her to be indicted so they can stick in a replacement who has a better chance of winning.

Then, she will be pardoned by Obama before he leaves office.

The only chance I see for justice is if she's not charged until after she loses the election. Of course, if she wins, she pardons herself, takes control of the Supreme Court and America loses.

In 2008 Hillary started the "Obama is not a US Citizen" movement. Trump ran with it.

We will see if Obama is a kind and forgiving soul. Maybe he's been playing the politics game the entire time and will never forget what the Clintons said about him or did to him.

Politics could get a lot more interesting in the coming months. Obama selected Comey (Republican) as the FBI Director who operated under Bush as Deputy Attorney General over Lisa Monaco.

I do know that Judge Napalitano on Fox has been saying she is most likely in violation of  gross negligence of the Espionage Act as is the original premise here. Over the months he has documented others that have fallen to this for doing far less.  And he has been saying it for months from the leaks that have dribbled into Fox News and other smaller outlets from someone(s) inside the FBI or Justice Dept. investigation about what has already been found.  Catherine Herridge has been doing a really good job of gathering as much info. as can be found.  I think what is slowing this down to where most of us would like it to be is Comey is doing his best to put an airtight case together that can not be taken apart.  And in doing so the investigation probably also revolves around the ( Clinton Crime Family Slush Fund otherwise know as the Quid Pro Quo for politcal financial favors both foreign and domestic ) otherwise know as  Clinton Global Initiative  where a whooping - some years 8 percent, some years 10 percent - of moneys actually find its way to a charitable cause, ( dang those administrative costs can be a bitch ).   Us out in the hinterland can only play connect the dots and read between the lines and get stewed and steamed, something I have become very adept at during my life.
