A couple of questions

Why should any President have this type of authority?

Would Hillary or Trump use this to their advantage?

Any answer would be with the understanding that if this happens we are no longer freemen and women and we now have a dictatorship.

Obama cannot suspend the Constitution. He can USURP or IGNORE the Constitution, but ONLY if We, the People allow him to get away with it. We probably shouldn't do that. Not for him, nor for any other man... including Hillary.

Below is the laws that make this happen but I wanted to ask does anyone want this type of ability in Hillary's hands or Trump's hands? You can research this yourself but its all there.




Executive Order Number 12148 created the Federal Emergency Management Agency that is to interface with the Department of Defense for civil defense planning and funding. An "emergency czar" was appointed. FEMA has only spent about 6 percent of its budget on national emergencies. The bulk of their funding has been used for the construction of secret underground facilities to assure continuity of government in case of a major emergency, foreign or domestic.

Executive Order Number 12656 appointed the National Security Council as the principal body that should consider emergency powers. This allows the government to increase domestic intelligence and surveillance of U.S. citizens and would restrict the freedom of movement within the United States and grant the government the right to isolate large groups of civilians. The National Guard could be federalized to seal all borders and take control of U.S. air space and all ports of entry. Here are just a few Executive Orders associated with FEMA that would suspend the Constitution and the Bill of Rights. These Executive Orders have been on record for nearly 30 years and could be enacted by the stroke of a Presidential pen:

EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons.

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President.

EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.

EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President,

Congress cannot review the action for six months. The Federal Emergency Management Agency has broad powers in every aspect of the nation.

FEMA's powers were consolidatedby President Carter to incorporate the...National Security Act of 1947allows for the strategic relocation of industries, services, government and other essentialeconomic activities, and to rationalize the requirements for manpower, resources and productionfacilities.1950 Defense Production Actgives the President sweeping powers over all aspects of the economy.Act of August 29, 1916authorizes the Secretary of the Army, in time of war, to take possession of any transportationsystem for transporting troops, material, or any other purpose related to the emergency.International Emergency Economic Powers Actenables the President to seize the property of a foreign country or national. The item reproduced above purports that President Obama issued a whopping 923 executive orders in his first term (compared to about thirty each for previous presidents) and offers supposedly alarming provisions of some of those orders. However, the entirety of this item is erroneous.

First of all,

the number of executive orders issued by President Obama is grossly exaggerated here. Through his first term (i.e., the first four years of his presidency), Barack Obama issued 147 executive orders, not 923. (Now into the final year of his second term, President Obama has issued a total of 227 executive orders.) Moreover, compared to President Obama's predecessors in the White House, this is not an unusually large number of orders for a modern president: President George W. Bush issued 291 executive orders during his eight years in office, while President Bill Clinton issued 364 such orders over the same span of time.

The listing of numbers of executive orders issued during the terms of modern presidents included in one of the examples above also bears no resemblance to reality. It's not Obama hating, or attributing the orders to him.

I think Robert is mentioning this as a framework of what "could" go wrong in the extreme situation of miss - use or tyrannical control.

To be fair, I think the spirit the orders are written are for sweeping emergency events, such as outbreak of disease or NUCLEAR WAR.  both very real concerns in the times they were written.

Robert, I wouldn't worry so much about it happening right now.  There are A LOT of standing institutions of our society that would need to be dismantled almost simultaneously,  and the citizens,  industry,  and local governments would all be roadblocks.

It will take much more than race riots and guerrilla warfare to turn the ride of the nation.

Even if the POTUS, whom ever he or she may be, freaks out and balls up crying in the corner.


It's not the big fight we need to watch for, it's the little things,  day be day, session be session,  that we need to take ownership of as citizens.

Just my opinion but, Executive Orders my ass.

The authority to do something or anything assumes one has the power to enforce such orders.    Those that support the Constitution will never allow such a take over.   This, I do believe.

Only those who support using "other people's money" are followers of the anointed one.   When that well runs dry and they have to pull their own weight, they'll change their tune.

While I did not say that Obama issued those orders except for the last one. Which Snopes in their usual bias has made it appear as the orders are not real.

All they really meant to do was discount who wrote them not the validity of them.

Trump who has said lets make America great again and has used the legal remedies afford a normal citizen.  


We are at a time when the economy could be pulled out from under us just like they did in Europe. There are so many ways and reasons this could be implemented. The great depression didn't take long to roll out but unlike then today it could result in the loss of the US as we know it. The US is currently in a state of emergency, This act alone gives the president broad reaching powers.

Let me remind all that O has suspended Posse Comitatus Act, has made a law allowing UN police in the US. He has followed UN laws in trying to implement them in the US and will allow foreign forces in the US. In fact some are here "training" right now.

In 2006, Democratic Congress modified the Insurrection Act as part of the 2007 Defense Authorization Bill (repealed as of 2008). On September 26, 2006, President George W. Bush (similar to EOs issued by Kennedy during the Cuban Missile Crisis) urged Congress to consider revising federal laws so that U.S. armed forces could restore public order and enforce laws in the aftermath of a natural disaster, terrorist attack or incident, or other condition. These changes were included in the John Warner National Defense Authorization Act for Fiscal Year 2007 (H.R. 5122), which was signed into law on October 17, 2006.[7]

Section 1076 is titled "Use of the Armed Forces in major public emergencies." It provided that:


The President may employ the armed forces... to... restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition... the President determines that... domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order... or [to] suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such... a condition... so hinders the execution of the laws... that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law... or opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.[8]

In 2008, these changes in the Insurrection Act of 1807 were repealed in their entirety, reverting to the previous wording of the Insurrection Act.[9] It was originally written to limit Presidential power as much as possible in the event of insurrection, rebellion, or lawlessness.

In 2011, President Barack Obama signed National Defense Authorization Act for Fiscal Year 2012 into law. Section 1021(b)(2) extended the definition of a "covered person", i.e., someone possibly subject to detention under this law, to include:

A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.[10]

Section 1021(e) purports to limit the scope of said authority with the text, "Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States."[

To me, and that is just me, it appears that there is Universal confusion in local law enforcement, the military and all branches of government regarding EXACTLY what the mission statement and role of FEMA and the remaining federal government and what may be done and what must not be done.

The thought that the government can TAKE what is mine or yours should bother all of us.

Whether it was Obama or Teddy Roosevelt who passed the executive law does not matter really does it

To me what matters is that ALL OF US CITIZENS MUST know the true marching orders, the plan in place so we can know when it is being followed and when it must be put aside.   These plans need to be public.  Otherwise we have some animals more equal than others

How can a good citizen be able to resist an unlawful order in the name of the Constitution when called to do so.  I believe our servicemen and women swear an oath to defend the Constitution and will not willingly allow it to lose its place as the centerpiece of our nation
