There was a guy who was well qualified applied for a high level job in City management and got the job. Once his boss found out he was a lay minister in his church on weekends asked him for a couple of tapes of his sermons. The guy figured he was interested and promptly gave him a tape. Next day he was fired.

Try that with a Muslim and see where that gets ya!

Try anyway.  Religion IS a protected class.  Just because one lives there, there are still protections.

Talk to a labor lawyer.

Tell him to get in touch with this organization who has defended and won many similar incidents including the military. If you look on their site you will see this is not an isolated case and it can be won. Most of the time its free also, they take contributions to cover the cost.

What happened to him was just plain wrong. As long as he was doing his job competently and was not actively recruiting for his church he should have been left alone.

The person that should be fired is the manager.

Seems to be a bit of a disconnect in this story.

What was on the tape or what were the sermons about? Was there something bordering on criminality or suggesting to the congregation that they should undermine the City government?

What was the reason given for the termination?

Are we sure the tapes or his religion was the issue?

I guess the point is that the story is lacking in details.

This is somewhat true. In Indiana (and all other "at will" states), you can fire an employee for a good reason, a bad reason, or no reason whatsoever. BUT, you cannot fire an employee for an illegal reason.

For example:

Good reason: He is a lazy bum.

Bad reason: He is the best employee I have, but he is a Chicago Cubs fan.

No reason: I feel like a change.

Illegal reason: He is black, a man (or woman), a union supporter, or due to his religious beliefs (or other illegal reason).

There is not enough information to conclude that he was fired due to religion, but IF that was the case, he cannot be fired on that basis even in an "at will" employment state such as Indiana.

That said, there is a highly complex body of law and confusing burdens of proof in proving that an employee was fired for an illegal reason.
