I just saw this morning on "CBS This morning" that the House and Senate are working to revoke the rule that puts certain people onto the "blacklist" for gun ownership.  I know some of you were upset that this rule was put into place (rightfully so, in my opinion), so I hope this works out as good news.

Have a good day.

Those "certain people" were those that a court and psychiatrist had deemed so mentally ill
that they could no longer take care of their own finances and every day needs. I worked in
a hospital psych unit and attended some of these hearings. These poor people were in no condition
to be responsible for a firearm. This is a stupid move, in my opinion. The same NRA that blames
mental illness on most domestic terror events is being hypocritical in supporting this.

NOT the purpose of the SSA.  This is clearly political abuse from the anti-gun Obama administration. You know cursed well that Obama would and did take every step he could get away with legally and illegally to reduce the gun count in the hands of patriots to reduce the muders in his home town when the real problem is not the guns, it's social responsibility and fatherless thugs.  With this paintbrush they can radically reduce the freedoms of folks who should not be so reviled and need to protect themselves from those same armed criminals and thugs. I could lose my gun rights as a Vietnam veteran and SS recipient, if I ask my accountant for advice on SS matters.  I have carried legally, concealed for 13 years and somehow my guns have not attacked anybody.

Good news.  Can't happen soon enough.

When my father in law's wife died he had all his SSA and VA benefits set up so my wife could administer them, since he wasn't in an emotional state to deal with them.

Under Obama's rules that would bar him from his basic civil rights.

So yeah, time for this rule to be reversed.

Anyone adjudicated as a mental defective will have their civil rights in regards to the 2nd Amendment revoked without due process to reverse it, that is the right way to address this, not a blanket automatic ruling from the SSA.

...it should tell you something that even the left wing generally anti-gun folks at the ACLU are in favor of revoking this Obama rule.

I agree the law was not specific enough. But, it's intent was to bar those with severe mental illnesses....not emotional issues. Plus, a person could appeal the decision.

• The policy would not take away guns from people who already own them. There is no indication that this policy would take guns away from people who already own guns. Rather, the policy would affect the ability of some mentally incompetent people from buying new guns.

What some don't know is that, according to the American Legion,  the Veterans Administration bureaucrats as of now, can arbitrarily turn a veteran's name in to the FBI list, if he has anyone else manage his finances. No professional evaluation needed.

This was in effect before the SS provision, as far as I can tell.

Not good.

Quote from: Those gun nuts at the ACLU
the SSA [Social Security Administration] promulgated a final rule that would require the names of all Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) benefit recipients – who, because of a mental impairment, use a representative payee to help manage their benefits – be submitted to the National Instant Criminal Background Check System (NICS), which is used during gun purchases.

We oppose this rule because it advances and reinforces the harmful stereotype that people with mental disabilities, a vast and diverse group of citizens, are violent. There is no data to support a connection between the need for a representative payee to manage one's Social Security disability benefits and a propensity toward gun violence... the rule automatically conflates one disability-related characteristic, that is, difficulty managing money, with the inability to safely possess a firearm.

The rule includes no meaningful due process protections prior to the SSA's transmittal of names to the NICS database. The determination by SSA line staff that a beneficiary needs a representative payee to manage their money benefit is simply not an "adjudication" in any ordinary meaning of the word. Nor is it a determination that the person "[l]acks the mental capacity to contract or manage his own affairs" as required by the NICS. Indeed, the law and the SSA clearly state that representative payees are appointed for many individuals who are legally competent.

(As I explained before, in some detail) whether VA or SS, these lists were of those who had a fiduciary appointed to handle their finances (govt disability money)..... for any reason at all.

While some may have actually been psychiatrically evaluated and had a competency hearing with a judge, many had nothing of the sort.  They just had family complaining they wasted their money.  Having a financial rep appointed for you by VA or SS is not the same thing as being found incompetent by medical professionals and a judge.  I have no problem restricting firearms from adjudicated incompetents (indeed I support it).  I have a big problem restricting everybody on the list, just because they are on the list.  Especially because firearm ownership is one of the specifically enumerated fundamental liberties secured to all citizens in the constitution.  It ought to take more than being put on a list to lose that right (unless you also have been adjudicated incompetent) .

The road to hell is paved with good intentions

I think this one is a win for the constitution and the american people

Unfortunately or fortunately, there does need to be a mechanism for helping to ensure those with mental illness do not become the vehicle that kills innocent people

Therapist,  lets hope that the new administration addresses those issues  But we have to get the cabinet installed, the wall going and the process of vetting immigrants past those knuckleheads in the 9th circuit.  If it were me I would disband the circuit and start over but I am a bit impulsive sometimes.
I cant wait to hear how vets will be able to go to any hospital for tests and treatment once the dust settles.
