Hey my all knowing group. I need assistance for possible action against somebody.
The dealer has had my KTM since 4/18 and about $9600 in approved parts and labor. The bike has been parked in the sun everyday. It is brought in at night.
Now my issue...sun fading.
I know the bike is getting baked in the sun Phoenix/Mesa and it is starting to get into the HOT time of the year. I have already brought this up with my insurance company aand they have said that it would be between me and the shop. My argument is that because they did not do a thorough damage appraisal, that almost a month has been added to the repair time...
I am so fu#king mad I could spit but I am trying to be cool until the end when I inspect the bike...
The way I see it at this moment is to refuse the motorcycle and not sign the two-party checks so the dealer gets paid. Again, from the side of just throwing stuff against the wall, could I file a comprhensive claim for the stuff that is faded (one black anodized aftermarket mirror extension has turned gold)...thanks in advance for helping me

No, I do not only ride at night but if you know how brutal AZ sun can be this time of year you might understand...but on a bike that was only 90 days old, kept in a garage and under covered parking, I believe it is a valid concern.

The sun here is brutal. I have a Nissan Titan truck that the sun has disentegrated the dash. Wood, cloth, plastic, paint takes a beating here. It's hard to imagine how so, unless you've experienced it.

Make sure in writing that you are only going to accept a bike that appears to be a 3 month old well cared for machine that looks and performs as a new bike. Also make sure they know that you are aware of how they are storing the bike.

I had a hood painted once that was not acceptable and I informed my insurance company and they allowed me to take it to another shop to be redone. Don't know if the first shop got paid, nor did I care.
